  • That's a cracking post that. 'Since my season ticket was in the house I did actually have a ticket.'
    So if you were to go to a concert and when you get to the front door you are asked for your ticket you say 'oh it's at home but since its at home I can still come in right?'
    They'd laugh at you.
    The way you're portraying the story on here it seems you act quite cocky. Showing the conductor/guard an old pass, mistakenly may I add, puts the guard in the mindframe that you're trying to pull a fast one.
    Did you try and tell him that you made a mistake and you will were willing to pay for a ticket?
    You won't get far if you don't pay the fine and if your in the legal proffession or associated with it you don't want to have to be going to court.

    OH really?! thats funny coz the tube ads i saw posted in the summer all offered minimum wage.

    however if they are paid 22+ then their attitude is even worse.... mind u SWT staff r the worst out the lot they have zero respect for people other than those in their uniform. they're up their own cracks just as bad as the tube staff.

    That's funny, I was under the impression tube staff were on more still, than SWT staff...Even station staff working for LUL get around £25,000pa.

    Lastly, the PFN is a civil debt problem handled in a small claims court, if you appeal to the TOC and lose then my advice is pay it, as in theory you were travelling without a valid ticket, the TOC can cancel the PFN and prosecute you as a fare dodger in a Court of Law. Also you can only get a CCJ if you fail to pay the fine imposed on you by a court.

    The above is almost correct. I have always believed that Penalty Fares are civil debts, but you will probably find that RPI's and TOC's will argue differently. The problem is, I don't believe any TOC has ever tried to recover a Penalty Fare in the county court. Presumably the reason for this is that it would set some sort of precedent, which may not be in the TOC favour (think back to Bank charges, when after the precedent was set even in the small claims process people had no trouble recovering their charges)

    Firstly, you are not going to be prosecuted for being a "fare dodger" - you had a ticket, but were just unable to show it. So lets make it clear the train company will never convict you under "travel without having previously paid the fare and with intent to avoid payment thereof". It would be impossible to convict someone with intent to avoid payment, when you already had PAID (assuming you can prove this of course).

    You are more likely to be prosecuted under the railway bylaws which make failing to show a valid ticket a strict liability offence. However, i don't know how common this type of prosecution would be. This is why if you ever forget your ticket, you should buy one and then claim it back later....

    What you need to do is photocopy the ticket in question, and write a nice letter to SWT's revenue protection department apologising for the confusion... and see what happens!

    Haha, good analogy. I would probably have tried but returning home to pick up my ticket would still have been an option for entry.

    In addition, who would be laughing at who if when you tried to enter under those circumstances they demanded a fee for wasting their time checking the ticket? Perhaps it wasn't such a good analogy after all.

    And who are UKYP? are they a new party? Are they able to change the railway bylaws? No? didnt think so.

    That wasn't the implication of my mentioning involvement with them. I'd write up a clever analogy to make you look even more dumb but your role as a troll in other threads is all too well established!

    Thanks for that newfoundglory. I've already created an appeal with IRCAS including a scan of the ticket and the invalid PFN uploaded.

    I'll most certainly be returning to this thread with the outcome.
