TALK TALK Small Claims Court Settled in Full

  • i,m sorry to say this but don,t hold your breath. Getting an enforcement may be very difficult. I also got a judgement over the purchase of a defective phone. I got a cheque after a warrant was issued, the cheeky swine tried to negotiate after the judgement was made. They also withheld the warrant fee. Its worth remembering that they could apply to have the judgement set aside. I,m currently waiting for the bailiff at brentford county court to get the warrant fee, he has warned me that it may never happen. He finds it impossible to get access to the premises and things are very secure. He cannot make forced entry onto the premises and there is very little of value in their reception to sieze. Apparently the shops are franchised so the bailiff cannot sieze goods from the retail premises.??????? This company has little regard for legal processes. I wish you the best of luck. This outfit knows how to play hard ball. It may be worth making representation to OFCOM and various other powers. Oh yes and they are still taking payments from my bank account, I,m going to have to take them to the county court to get the contract stopped, assuming I can get the wording right.

I would not sign or receipt either to them or the court untill cheque had cleared, also would not hesitate to take the same action again if put in the same circumstances. Good luck with your claim. cullin

I've looked at the HMCS moneyclaims site but I'm not eligible as i live in Scotland.

    1) Anyone point me in the right direction for pursuing an action via Scottish system?
    2) I presume that the Sale of Goods Act applies UK wide?

Not as easy as in England, but you have to make a claim through your local sherriff court. if you go along though, they're usually very helpful - I reckon you'll be looking at Small Claims, so once you've filed, they have a month until the court date.

There's more information on Scottish Courts procedure on the consumer action grup site - different reason for going to court though.

Otherwise, check out the Govan law Centre. http://www.govanlc.com/

    Really good.

  • In response to post from Aiadi on 24th. Please can you keep in mind that Carphone has thousands of good, honest people working for them who take alot of grief for the mistakes made by Charles Dunstone etc. Before anyone else says it, yes I am one of them, and belive me it frustrates us just as much as you but we have ABSOLUTELY no power over the issue.

Your comments about bankrupcy are ill thought out and frankly insulting to the many, many staff members of CPW who fight against the system and FOR our customers every single day.

Happily wishing for mass unemployement is not going to help any TalkTalk customers or solve any customer care issues.

Thanks for that as another (unhappy) member of the cpw staff Please do wish for us to lose our jobs (although I am looking for another)

I am a branch manager of a cpw branch I do a good job and help my customers as much as possible but please remember we hit brick walls too we do not have the support in place to help us help you.

Can anyone give me a working email address to send my complaint to.

I was on tiscali broadband and calling package and was happy with the service, but due to financial difficulties had to cut back on bills. Read about talk talk and signed up. Perhaps I should have done a little research.

I never received a welcome pack and happily carried on making calls thinking they were free, until I got my next BT bill and discovered I was being charged for calls. So my tiscali calls had gone, and I was being charged by BT. I then got a bill for my talk3 International package.

I emailed customer service to inform them that I wished to cancel as I had never received welcome pack. Called India every week for three weeks, they were unable to discover what had happened, I eventually said i wished to cancel the service.

I have now gone back to Tiscali and have the line rental, phone calls and broadband in one place. However, Talk talk have continued to bill me every month. I now 'owe' £50 and have passed me to a debt collector who are threatening to come to my house to collect the debt.

I had a very frustrating 40 minute phone call with Talktalk who have now decided that they will cancel the service, but I will have to sort the debt out with the debt collection agency myself. Thanks! In the operators words they cannot take over a line when the customer has calls with one operator and line rental with BT, so what are they charging me for.

In a nutshell - I have never used the service, never had a welcome pack, and have never paid them. What can I do??

Unfortunately Sammy their inefficiency relies soley on the client breaking the contract ie ceasing payment etc etc, therefore handing them the very weapon they then proceed to hit you with. I paid paid never ceased and now get two free years (aprox). You must seek better advice than mine, but I feel that if you could prove that your actions were justified through theirs, you might I stress might have a case. Seek the advice of the trading standards officer and the opinion of your local CAB. Wish I could be more helpful, but to anyone else DO NOT STOP PAYING, START SUING! if they do not provide what you bought.
