    Retailers probably already allow for this in their margins anyway so no point in feeling sorry for them - especially after what I've been through.


    I think you find that they don't allow for that in their margains! Thanks to the internet the bed trade is very very competitive, hence why Dreams beds have their own names on the products!

    Some online retailors are selling £149 single matts and buy the time they pay the VAT, the delivery charge they are making less then £20. Is it worth it. Then customers expect stores to match or even beat that price.

    For the record I'm in the trade, but only sell from a shop. I've had many a discussion with Mr Deegan and the whole thread got deleted. He seems to have some power on this forum and you are not allowed to go into a public debut with him. Most of his advice is very sound.

    But he does IMO use this forum very much to promote a 2 sided pocket sprung mattress, which MUST be turned. Even if the customer is looking for a 1 sided mattress for convience.

    If you don't turn a 2 sided mattress every month, then the gurantee is null and void. Just like not getting a car serviced!

    I would hope by now that MSE, would stop him from using this site as it is very clear who he is and what he does for a living. Not excatly inderpent is it.

    It is completly irrelevent as to what the retailer does with any goods returned under DSR. The regulations are not there to protect the retailer they are there to give the consumer the same rights they would have if they went into a shop and viewed/touched/bounced about on the goods.

    Perhaps you could point me to the relevent part of the legislation that exempts mattresses and indeed ask trading standards the same question.

    You will need the answer for the first time you try to defend yourself against a claim in court...

    and don't try the 'goods which cannot be returned' bit - this applies to goods that physically cannot be returned. If you can return a swimming costume, shoes, a sofa etc, you can return a mattress. as the Trading Standards for their advice in writing before relying on it. I suspect they will decline.

    Perhaps you could speak to someone "Official" and let us know your findings?

    I'm just repeating what my findings where.

    It may have even been the OFT that I spoke to it was a while ago now.

    Think you will find that you can only return a swimming custome if the piece of plastic in the groin area is still their. Because of hygene reasons.

    Or, ( as this is a money saving site), for those that don't have an anytime call package including 0845 numbers, or using a mobile, then use the 020 number from the OFT's website ;-

    Exceptions to the right to cancel

    13.—(1) Unless the parties have agreed otherwise, the consumer will not have the right to cancel the contract by giving notice of cancellation pursuant to regulation 10 in respect of contracts—

    (a)for the supply of services if the supplier has complied with regulation 8(3) and performance of the contract has begun with the consumer’s agreement before the end of the cancellation period applicable under regulation 12;

    (b)for the supply of goods or services the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;

    (c)for the supply of goods made to the consumer’s specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;

    (d)for the supply of audio or video recordings or computer software if they are unsealed by the consumer;

    (e)for the supply of newspapers, periodicals or magazines; or

    (f)for gaming, betting or lottery services.

    See above in Red the reason being it would be unhygenic to return a used mattress.
