Finally got a result; after raising a claim in OCT 2010 for 3 years tax overpayments to be refunded for my Dad, and two letters of complaint against HMRC for their mishandling of the claim, we have finally received an appology from HMRC's final stage of the complaints process, together with a full refund of the amount owed (£379.98)
Also, in recognition of the fact that HMRC admitted the complaint had not been handled correctly, they will shortly be making an additional £30 payment as compensation, which at least will go towards the costs of all the phone calls, letters, etc. that we have had to make to get a resolution.This is a system account and does not represent a real person. I was interested to read BAA1's post above. I previously posted at post # 247 in this thread.
HMRC told me I owed £600 for three past years, I told them I didn't think I owed this amount, They threatened that "distraint" proceeding would start the following week. - this is where they take your assets and sell them at public auction.
I asked them to tell me where this tax liability came from as I have a low income. HMRC then lost all the correspondence, I sent them some copies, I made a complaint as they kept not answering my letters. Then they agreed that they owed me £180 that they have now refunded, then when I argued this was not right, they agreed that there was another £300 that they have now refunded me. I have argued again and they have sent another £10.
By my arithmetic, they still owe me another £100 or so, which I told them about, but they have forgotten, (but I will remind them).
They now say that if I am not satisfied with the way they handled my complaint, I can write to another of their departments. I have told them to forward the papers to this other department, themselves.
There has been no apology, or any recognition that they made any mistakes. They have threatened me over money that I did not owe, and had three goes at refunding the right amount, and still not managed it, yet.
Well done, BAA1 for getting an apology and some compensation for the aggro that HMRC have caused you.

They passed on my complaint to a complaint handler based in Bootle who was the only complaint handler that fully grasped the case and sorted things out.
Each of my letters included full calculations to back up my Dad's claim amount, and each letter expanded on the description of where HMRC were making their errors, detailing where they were missing the point.
Keep on at them, mark your letter and the envelope clearly as "COMPLAINT CASE", include copies of your own calculations highlighting what HMRC are getting wrong, if they do not resolve your complaint, then they should give you details of how you can escalate your complaint to the Adjudicator's Office.
Do not assume that the complaint handler dealing with your case is an experienced tax officer, you need to be lucky to have a good tax officer assigned. I'm awaiting a reply now. So far its been easy. In the past i've tried over ways to contact the inland revenue and have mainly had trouble finding dates and files at my end as my filing isn't the greatest.
here to hoping for a 4 figure rebate

Don't know about anyone else but I find the tax office infuriating and very confusing to deal with. I have recently started back to part time work after retiring at the end of March. Because I have two tiny pensions of approx. £22 per month and a small state pension of £35 per month, when I started work my tax code was "BR"and I was told this was because it was classed as my second or third job/pension and so all my allowance has been allocated to my first jobs/pensions. I think I am paying too much tax but I tried to ring the tax office and I kept being referred back to the web site and on the third attempt was kept holding on so long I had to give up.
What I want to know is, if I have already submitted a P46 to my employer and am still on a tax code "BR" after a month at work, will the tax office amend my tax code to reflect the balance of personal allowances I am allowed to claim for? I did get 3 new tax codes for the 2 pensions and my previous employment back in Oct 2010 (I retired in March 2010).
What I don't understand is that on the last tax code for my employment which I received in Oct 2010 they calculated that my state and private pensions would be £3808 for 2011/12 but I do not receive the extra £60 per week state pension until the end of September and they have taken the full amount up to the end of the tax year off my personal allowances. Even so they calculated my employment tax code to be 2660 but I am paying £30 per week off a salary of £152.
How can this be right and how can they tax me on pension I haven't yet received ?
Can anyone advise me what to do, or if this is correct ?:mad:0 -

Your topic is not really related to this thread "Tax Rebate SUCCESSES" you may get a better response if you copied / moved your post and created a new thread in the Cutting Tax forum.
However, at first glance, in your circumstances, I believe you need to contact HMRC who will be able to adjust your tax codes based on the incomes you receive from your new job and the various small pensions. You will need details of income from each source so that HMRC can calculate the codes correctly.This is a system account and does not represent a real person. After reading the topic described in the site, I looked up my tax code and noticed it was BR for 4.5 years on my last employment.
Since it was my first job in the UK, and I had joined in the middle of the tax year, it was assigned as an emergency code.
After calling HMRC, I was told that P60's for the last year was missing, so they couldn't comment on anything till I sent a copy of it to them, and after that everything had do be done by post.
Luckily my old employer was quick sending me the documents, and since I was certain I was going to be refunded, I sent the documents with a letter including my bank account details.
Well, after 4 weeks I received a letter with calculations on how much I overpaid, and a week later £6438 :eek: was transferred to my bank account.

After waiting for months i have finally received £3645 from HMRC but its not been without a struggle. but heigh-ho its all sorted out now thanks to all the people who helped me on this site.0

Similar thing for me - turns out I've been on the BR tax code for about 5 years - several months and letters later, I'm looking at a cheque for - wait for it - £6,705!! :j0
