This, I understand is not allowed and also cold calling is debatable (although if you query this with the MOJ they can say that you may have signed/ticked something within a loan that stated your data could be passed around!?)
They are very sneaky about collecting the fee, they do collect it immediately but they also send you an email with their terms and conditions which allows them to get round it, which means they are not doing anything wrong when they steal your money, as you have had correspondance from them.

Perhaps this may help in your situation. Have a read through and see if there is anything they did out of order
Taking Upfront fees
What this means for your business and up-front fees
Whilst you can take a payment or fee from a client before providing the service you must first provide the required information to clients. The purpose of Rule 11 is to enable clients to make an informed choice based on the pre-contract information provided.
You must not take a payment or fee before this pre-contract information is provided in writing and the prospective client has had reasonable time to consider the information. A reasonable time is not defined, as what might be reasonable for one person would not necessarily be reasonable for another. But we would always consider it unreasonable to provide the information at the point of contact – whether it is a cold call or the prospective client contacted the business – and request a payment or fee.

Lifestyle claims should be thoughly investigated by the trading standards people and the office of fair trading, they,re bloody crooks!!! they have no qualms whatever about who they steal money from!!!0

Hi Marshallka, thanks for your info,,to be honest.I don,t remember how this all took place,,it was so fast it left me quite stunned,,I don,t remember any e-mails from them,I think they sent me tx message on my phone,0

I certainly did,nt have time to consider what they had told me,before they took the money,it was gone within seconds of them explaining things to me0

You need to make a complaint to the MOJ then and see what they say. Make it plain that they did not follow the rules set out by MOJ when they took your money. There is also another option to get your money back but would depend on how "sure" you feel the courts would side with you and that is moneyclaim online. They do charge however so another risk! Hope you get somewhere with the MOJ though. What is the point of them regulating claims management companies if they allow them to get away with rule breaking.
Good luck0 -
Thanks for your useful input Marshallka,I,m still so angry with their response,I,ll call the MOJ Monday, and see where I go from there, they requested my payment on the first contact with them, and also took money, before I,d put the phone down, their contact told me this as we spoke..I,ve just sent a letter off too their complaints department, addressed to a Mr George Stanton,,but,I don,t hold out much hopes with him,if he,s in their employ too,,Thanks again..0

Hi Chris
I contacted my credit card company from the account they took the money from and they have made a note on my account should i not get anywhere with Lifestyle. This way i am covered and will be refunded the amount taken. If you haven't already done that it may well be worth contacting your credit card company. MOJ were very helpful with me so its well worth a call.
