    Hi Baz

    DO NOT sign any documents from Redhawk Legal - they have no right whatsoever to request that you have to sign with them . Please refer this matter to the MOJ + the Trading Standards at Burton upon Trent.

    We are visiting the TS shortly and will also bring up details of your plight with this company in the meantime politely tell them that you will not speak to them on the phone and that they must keep everything in writing from now on.

    Have you contacted Egg to find out if you are entitled to a settlement and that if they do have a settlement please advise them that you have NOT signed any paperwork with Redhawk legal.

    As Milly advised, do not sign any documents from Redhawk or Ultimate Law. Despite what Redhawk say they are not ''taking over'' Lifestyle Claims, they simply bought the customer database from Lifesyle's administrator.

    You must contact Egg immediately and tell them not to accept any letters of authority from Redhawk (or anyone else) that purports to have your signiture on it that gives Redhawk the right to have Egg pay them your PPI refund directly.

    If Lifestyle Claims originally contacted you in a cold call they had no right to pass your claim on to a solicitor and Ultimate Law had no right to take it on and charge you.

    Ultimate Law say they have no connection with the CMC's when they took the case over they took out an insurance policy that would cover their legal expences if they lost so I wouldn't have to pay them.

    I don't have Egg's number but I'm sure you can Google it.

    I've seen plenty of Ultimate Law's correspondence in which they clearly state that they are indeed passed Lifestyle's and Redhawk's claims and that they pay them a referral fee for doing so.

    And don't believe them when they say their legal expenses are covered by ''insurance''. I know someone who was spun the same tale but was presented with a bill for legal work for £4k. And that was for a PPI case that had won.

    Hi I have just sent this email to Chris Wood at MOJ

    "Hello
    I have been informed that you are the compliance officer for the above
    claims management companies, and I hope you can help me, in June 2011 i
    was cold called by a woman called Rhianne Quicke who was a claims
    adviser with lifestyle claims, she said that they could get my miss
    sold ppi money back within 8 months risk free. Subsequently I stupidly
    gave them my credit card details which they took £395.99 straight away
    without me even seeing any paperwork.
    I then didn't here from them for a while until I was contacted by
    Ultimate Law solicitors who stated lifestyle referred my claim to them,
    I had to sign an agreement for them to act on my behalf for my ppi
    claim against egg card, then in 2012 they contacted me to say that my
    case was going to court and wanted to know if I had legal aid insurance
    which I didn't so they said they would take out an insurance policy
    which would cover any expenses if the case was lost.
    Then in January this year Ultimate law phone to say Egg wanted to
    settle claim plus expenses paid if i agreed with the amount offered and
    that I should receive payment in a few weeks.
    Then on 6th March 2013 i had a phone call from someone from RedHawk
    Legal who said they were taking over Lifestyles cases and wanted to
    know if i had received my money from Egg card which I have not, he
    seemed to know all my details etc and said they would send a
    authorization form for me to sign to allow them to contact egg to
    release my refund, which to date has not arrived.
    I phoned Ultimate Law today 8th,March 2013 to see what was going on
    with my claim which the woman dealing with my claim said they were
    waiting for court approval or something like that, she was foreign and
    hard to understand over the phone, when i asked her about Redhawk legal
    I could hear her groan and sigh as if she'd be questioned before about
    these companies off which she said they had no affiliation with
    Lifestyle or Redhawk and that she could not discuss any agreements off
    fee's payable Lifestyle or Redhawk that I had made prior to ultimate
    taking my case.
    When I got home after work today I found in my post an Invoice for
    £1348.58 from Redhawk legal for a successful claim of £3746.05 against
    Egg Card and that I was to pay it within 7 days off me receiving
    settlement from Egg.
    Also enclosed was a photo copy of a letter from Mrs G D Sharma
    insolvency administrator for Lifestyle Claims stating Redhawk had
    purchased right title and interest that the administrator holds in the
    Customer lists, Goodwill, Customer Contracts and trading styles .
    Please could you advise as to were I stand as I had never heard or had
    any contact with Redhawk until this week."

    Indeed - the MOJ has banned CMCs from passing on details from cold calls to solicitors precisely because solicitors are not allowed to do so.

    More good news is that you can complain to the solicitor about it and, if necessary, to the Legal Ombudsman.

    In the contract of engagement that clients signed from Lifestyle Claims (CCR) it does say that they may pass the claim to Ulimate Law and that a percentage could be charged by them.

    At our face to face meeting a few weeks ago the TS/MOJ in Burton on Trent told us that it is not a cold calling because at some time or other we must have ticked/or left unticked on some documents that we wanted maketing calls. So their rules state they cannot cold call and under the TS/MOJ thinking this aspect could never be proven and therefore this rule cannot be actioned to CMC's ever.

    The trouble is that the TS/MOJ they have everything to lose if they suspend or cancel a CMC. They firstly get a fee for authorisation, there is no magic on who is allowed in, in other words you pay you can trade then they also get a percentage of fees taken so they are on a win win situation.

    Thankfully, the SRA's stance may be totally different to those of the TS/MOJ because it is very clear that they are cold calls and ULL may definately have broken a SRA rule and we are currently working with Baz and others who have had problems in this area.

    Redhawk do not have any relationship with ULL it was only Lifestyle Claims and ULL if it was on your contract of engagement.

    Now according to the TS/MOJ it is in the T&C's of Lifestyle that they can assign at anytime to another CMC. We are still working to ratify this as Redhawk have been asking former clients of Lifestyle to sign their contracts. One such person has had an estamp signature on Redhawks contract where no permission has ever been granted.

    I do have more info on this aspect of lifesyle/Redhawk but right now I have to keep mum about this as this is being worked on as we speak.

    So please everyone please be very careful with these CMC's, any contract should always be taken up with a solicitor before signing and definately NEVER pay an upfront fee as you can see they tie you up in knots and those T&c's are written in very small lettering but once the contract is signed they can vertually do as they like.

  • awful company will not refund money as quickly as they take it, never contact you and try to short change you with refunds and hope you dont notice

  • Hi everyone I have also been conned out of around 5,000 by lifestyle claims. Way back in 2010 I signed up and they were checking 6 different sources for claims which I stupidly paid for, all on a credit card as I too was told the money would be refunded if I won or lost. I continued to ring them and having taken soo long took 1 year to look at 2 of my claims I told them to cancel the process and asked them to refund me which they said they were unable to do as they had already started, even though after having taken soo long I refused to sign the next 4 claim forms. Anyway, you know the story they went into administration in 2012 just days before they folded I was still speaking to them. I too have the letter from sharma and co, I have tried to claim off my credit card company but they won't pay up even though I haven't recieved the service, is there anything else I can do to try and get some of this money back which I have paid out? Thanks
