    This is very true. Is your account showing that the money has been taken out for the direct debit?

    I'm sorry to say that there's not much hope, crisis loan wouldn't assist my severely disabled dad with taxi fares for his hospital visits after his bank took £100 of his IB in bank charges.

    You want to look into that, i am sure banks cannot take benefits to use for charges missed loan payments etc....

    Am i..? I thought if you were on benefits, they could not take benefit money from your account to pay loans, overdrafts etc and also use for ofsetting of other accounts. If i am wrong i apologise to the OP but i am sure i read it on this site somewhere.

    Yes, you are wrong. The SSAA refers to charges in the legal sense, not bank charges.

    A bank charge is a fee, penalty etc. A legal charge in the most basic sense is security for lending. For example, when a bank gives a mortgage they register a charge against the property for the amount they are owed.

    The first right of appropriation means that an individual can request that their bank ringfences a certain amount to cover essential bills. This has to be requested in advance, can be refused by the bank (though rarely is) and can be requested by anyone irrespective of whether they claim benefits.

    Ok fair enough. The general concensious from the little research i have done seems to be that if you are on benefits you have a right to this. I mean why have a first right of appropriation if your not entitled to use it..?. As you can say they can refuse but i think if you take further action they eventually have to give in and hand the money back. Can't find anything that legally quotes this but at the moment i really can't be bothered to look further into it.

    The information you need is the Social Security Administration Act 1992. But to be fair if you don't understand the terminology you will probably struggle with statute.
