Oh Dear
Got a reply from the fscs
Basically they are saying that they have to operate under a set of rules set out by the FSA ,these rules lay down terms that must be met before they can consider a claim, under their rules they can only consider claims in respect of mis-selling if the advice was given by the firm after 14th Jan 2005 which is when they were regulated by the FSA.
As my PPi were sold in 2003 they cannot assist me any further :(
unless i recieved any further advice after 14th Jan 2005
Another one bites the dust

Hi there

So sorry to hear this.

I would call the FOS on this then and see if there is something they will suggest, even though the FOS will not be able to deal with the matter either due to regulation issues, they may possibly suggest another avenue.

Give them a call and get back to us to let us know, cheers and fingers crossed.;)

I am sorry to hear this, do as di says and let us know how you get on. Think it is tosh about the ppi expired and loan past 6 years is time bound, there have been people on here who have claimed from the 90s,i did. Please dont give up, you will get there in the end x.

This isnt actually a time bar (6 yr rule) which the FSA say firms can reject complaints under. (baffles me why only few firms actually quote it)

Its just the fact that it was sold pre ICOB (insurance conduct of business/ when FSA regulated insurance) they will not apply the rules retrospectively.

I dont think they will get there in the end, as run out of avenues to go down. FOS wont help, FSCS wont help. Taking it to court would surely be only option.

Hi gethro

Hope you hear some good news very soon.

Also all the best for 2011.
Update,nothing much happening
Just realised that i haven't had a reply from capital one ,they cashed the £10 cheque on the 10/12/10 so i make that more than 40 working days. (is it working days or just 40 days they have ?)
I sent Citi the PPI consumer questionaire on the 31/12/10 but on the royal mail tracking it still says it is being redirected.
The easy money claim is now with Lloyds so i don't hold up much hope for that one either.:(

Hi gethro, get on to them and keep at them until they comply, tell them you will take this to fos if you have to, with regards to citi, give them another 7 days and if you have not heard anything then ring them. Dont let them get away with this.

Hi gethro

Sorry I missed this earlier, but can see amersall have posted up.
I would follow her advice on this, and keep at them.

As you know they do have 8 weeks, and to what I am aware of if nothing is heard at all by that time, you should still be entitled to complain to the FOS anyway, they would then follow this up for a decision.;)

Hi there, when fscs said they could not help, did you try the insurer? as some have gone down this route as they may have been regulated. It may be worth putting a complaint in to them.

I have written a letter to Capital one which i will post today,i have told them that i have now waited 76 day since they cashed the cheque and i have now taken the complaint to the FOS.

Still no reply from Citi and their 8 weeks are up at the start of next month.

Still no reply from the PPI claim i sent Easymoney(lloyds)which i sent 31/12/2010 ,when i check on the royal mail website it still says it was posted at 240-246 Kingsway BS5 8NS on 31/12/10 and is being progressed through our network for delivery ?

So thats another one i have to chase. :(

Hi there

with the lloyds one, you could email below to ask if they've received it, because sometimes the Royal mail online does not always confirm delivery for a few days, and sometimes never which is annoying, even though the complaint have reached the destination.

Try lloyds here.
customer.care.insurance@lloydstsb.co.uk

Some details of Citi if the correct bank.

Good luck and keep at them.;)
