Had a few replys from the letter iv'e sent,SPPL are investigating my complaint and Capital 1 want me to confirm my ID and address with a copy of a bill etc,my query is that Egg have sent back my cheque with a letter that says basically that as my account is closed they are under no obligation comply with my request for a copy of the original agreement.
    It says
Thank you for your recent request for an exuted copy of the credit agreement for account
with egg banking plc under section 78 (1) of the consumer credit act 1974.
As the account you refer to is now closed i have to inform you that Egg are under no obligation to comply with a request for a copy of the executed agreement under the consumer credit act as we no longer have a contractual relationship relating to this account, nor are we seeking to enforce any agreement on the acount.
The right to be provided with this information from egg banking plc ended with the closure of the account.
section 78 (3) (a) of the consumer credit act states that section 78 (1) does not apply where no sum is or will or may become, payable by the debtor' the right to request an executed copy of the agreement is found in part V1 of the act, which is entitled 'matters arising during currency of credit or hire agreement' so where an agreement is no longer current the right to request or be provided with a copy of the executed agreement therefore ceases.
Looking at the account i only had it for 6 months before i paid it off (2006)but i can't remember why i closed it so i would like to get all the info on it to see if i did have PPI .
    thankagain for all your help,:T

Got more or less the same letter today from Capital 1 Credit card basically saying that as i had closed both accounts in 2006 and there isn't outstanding balance's they do not have to send me a copy of the Credit Agreement and if i wanted more details i would have to send a SAR along with a cheque for £10.
Cheeky monkeys cashed my cheque but have asked for a £1 cheque to be raised and sent to me.
SARs request's to Capital 1 and Egg will be in the post first thing Monday morning :D

Just checked up on the letters i have sent and realised that i haven't had a reply from easymoney but i have had a reply from Lloyds who i never sent a request to.
I currently have a Credit card with them which i am paying through CCCS and this is the number quoted on their reply ? i know they have stopped claims for PPI so i never sent them a request.
So it looks like easymoney cards were issued by Lloyds (it says on my statements in association with Accuracard)the letter i got from Lloyds states that they are currently reviewing their processes so i assume this would this still apply to the card i am trying to claim for which i paid off in 2006.
Is it worth me sending them another letter asking them to check the account number as they have quoted my card number which i have now not the one from easymoney which i paid off several years ago.

    Hi All

I have had a reply from SPPL and it's not good, they have finished their investigation into my complaint and say that they were not party to any discussions in respect of insurance cover.
They have pointed me in the direction of the finance company who arranged the loan for me and have forwarded my complaint to them.
I have done a search on the FSA website and apparently they are no longer authorised
    taken from their website.
The Financial Services Authority (the "FSA") has cancelled the Part IV permission and withdrawn the authorisation of ***** ***** trading as The ******* ***** (the "Firm"). The FSA's action took effect on 6 April 2009.

As a consequence of this action, the Firm is no longer an authorised person for the purposes of the Financial Services and Markets Act 2000 (the "Act") and it may not carry on regulated activities which fall within the scope of the Act.

The reason for this action is that the Firm failed to submit a Retail Mediation Activities Return, despite the FSA's repeated requests that it do so. The FSA's Final Notice is displayed on the FSA website at the following address:

Is it worth me sending my complaint to the address i have for these people,SPPL did say that as the policy expired last year no refund is due and as the policy was sold more than 6 years ago the claim for miss selling may be time bound.

Getting fed up with this now. :(

    Hi there

Sorry to hear this, but if the business were regulated at the time of when you taken out the finance, and you mean they are no longer active, then you can make a claim through the Financial compensation scheme (FSCS).
    http://www.fscs.org.uk/contact-us/

Many of us have had to do this, but otherwise contact the Financial ombudsman service (FOS) and ask them on your next best step to take from here, there are ways to try around this, good luck.

Please let us know how you get on, thanks.:)

    Oh Dear
Got a reply from the fscs
Basically they are saying that they have to operate under a set of rules set out by the FSA ,these rules lay down terms that must be met before they can consider a claim, under their rules they can only consider claims in respect of mis-selling if the advice was given by the firm after 14th Jan 2005 which is when they were regulated by the FSA.
As my PPi were sold in 2003 they cannot assist me any further :(
unless i recieved any further advice after 14th Jan 2005
    Another one bites the dust
