Farepak in administration: What to do? (Merged Thread)

Unfortunately this friend is wrong. As an agent of Farepak hampers you are as the words says “An agent” which the Definitions of an agent is “a representative who acts on behalf of other persons or organizations”.
The contract is with Farepak and not with the agent whom was working on behalf of Farepak hampers.
The party that has lost out can only lodge a formal letter to add there name to the massive list of creditors, of which I think no one will get a penny back.

She has just been notified by one of her work mates that they intend to take HER to small claims court to get the money they paid to her as Farepaks agent back. Can they do this? She paid all money she was supposed to directly to Farepak and recently paid one of the final payments of over £5000 to them. Her work mates argument is that he had a contract with her not Farepak so it's her responsibility to make sure he either gets a refund or the items he has paid for.
Our friend has lost not only her own money but the commission she should have earned as well, so it's not as though she's sitting pretty in all this.0 -
looby - I don't know enough about the relationship between the customers, agents and farepak to comment on how successful court action against agents might be, but it is the only viable option. It may depend on whether cheques were made payable to the agents or farepak. There is no reason why a contract cannot exist between the customer and the agent.0

Why do you think an agent is called an agent, because they are a go between the customer and company.
The agent is only responsible to collect payment, sign the card and deposit said payments into Farepak's bank account.0 -
Read the terms and conditions on the back of your agents guide and this will explain your role between the customer and the company concerned and hopefully this will allay some of your fears.0

The blame for this FIASCO lies squarely on the shoulders of the Farepak Directors.0 -

I had no idea that so many people bought gift vouchers this way.
Always wondered why they did it as wheres the profit margin in it for them? At least with hampers they buy cheaper and make the profit there.
Maybe that was a contributing factor?
I would have thought the timing was a good indication of something illegal going on though.0 -
I've lost about 240 quid, but compared to others on this post my amount is small potatoes.
My heart goes out to rest of you who've based their xmas on the scummy ************* company and lost a lot more than me. I can manage for xmas luckily just wont be able to spoil my family etc with presents.0 -
Really feel for those who have lost money and those who are agents having the amount of anger from unhappy customers, and the expected commision, it's awful.
I'm definately staying clear of all things like this next year and buying the vouchers myself each month. One day I might be more organised...........
