No Access to Home without Several Speed Humps

There are three routes which can be taken to get to my part of the road. Two routes have multipal speed humps which i avoid and go the direct route without speed humps.

I have now come home to find there are four speed humps up the road. I have no access to my house without going over these and TBH i'm concerned for the damage to my car.

I come and go a bit and drive a 96 Corsa. I avoid speed bumps to lower the chance of suspension damage and knocking the tracking in my car out.

Two questions.

If my car does become damaged can i claim? and i assume this will come with a 'prove it's the speed humps' problem

and

Two, are they allowed to simply put them there? (thinking along the lines of you have to have 3 accidents for a speed camera to be errected, or something along those lines)

I'm pretty annoyed.
I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!

    I believe the local authority have to post notices to the effect that they intend placing speed humps. These notices are placed on lampposts immediately adjacent to the areas affected but would also be posted in the local press.

    They also have to have liaised with the local emergency services to ensure that it poses no problem to their vehicles in gaining access to premises etc.

    In the case of the speed humps in our local area, there was a public meeting to discuss the proposal with local residents - but that was several years ago when they were an exception and before they mushroomed all over the place.

    We've had them along our road for about 5 years now and I haven't had to have any maintenance done to my car that could be attributed to them - but I do drive over them with caution which, of course, is the reason for them being there.

    I'd get in touch with the council straight away and see what they say (I presume it's a minor road and so council managed rather under the Highways Agency ?) - there should be contact details on your council website.

    I don't know the exact legal position but when we had road calming measures installed recently, we were all sent plans of what was intended in advance and invited to comment - whxcih didn't stop a raisable post suddenly appearing in the bakc lane immediately outside my garage entrance. I complained to the council pointing out that it made it impossible to access my garage without either reversing from or into a major road and they removed it again within a week or so !

    Virtually impossible to make a claim for wear against a speed hump unless a poor condition- they'd want proof damage came from a speed bump and that car went over at an appropriate speed.

    The various Highways acts and Traffic Calming regs allow them to put them down assuming they adhere to standards.

    Usually they are targeted in placement- areas with above average injury accidents, persistent speeding issues or to force traffic off rat-runs. Apart from that behind good practice they can go down on most roads.

    Some consultation is usually done with police, fire, buses, local councillors and residents nearby but I do not believe it to be legal requirement for notices to be placed. The actual wording is- "shall consult such other persons or organisations representing persons who use the highway or who are otherwise likely to be affected by the traffic calming work as the authority think fit.” so I'd bet Ambulance, Fire, Police and local councillor and people directly outside.
  • There is a small sign on a lampost. I personall had not notice (normally looking past the mini roundabout to make sure i'm not gonna get wiped out on a morning).

    The road is about 300/400 yards from top to bottom with a small mini round about just before the top.

    There have been 4 placed down the road and they are the 'sharp shock ones' which even if i drive at 5 mph still criples my car. I personally do my best to stay away from them also as my knee's are not in the best of health and i find that jolting them does no good.

    There are no accidents and i don't persieve a speeding problem. My car passed it's MOT yesterday so i know it's in perfect working order and i'm 100% sure that i am going to have some damage as my car simply isn't strong enough to take going up and down the road what twice a day ( 4 speed humps. down and up twice = 16 bumps a day - 122 bumps a week)?

    On this point, I'm not doubting you but in my experience you'll find the public in generally poor knowing where and when accidents happen.

    The police/councils have databases full of information indeed seen many cases where the number of accidents has been much higher than the public anticipate!

    There has been one accident on the road in the 7 years i have lived on it and that involved three youths crashing while on a nicked scooter (i don't think speed bumps would have helped in that measure lol)

    Just rather annoyed as i do my damdest to avoid them and now it's totally impossible.

    If you go slow enough, there will be no damaged caused.
    I used to be indecisive but now I am not sure.

    The ones on my other route i go over at bearly 5 mph in first gear and they still make my entire car shudder.

    Even if i go over them at 10/20 mph it still jolts the car.

    I did see on another forum while having a nosey. If the road is 30 mph then you should be able to pass safley over the speed humps at 30 mph. I don't see this happening.

    The object in putting speed bumps in, is to slow the traffic down.

    I wish they would put some in my area.
    I used to be indecisive but now I am not sure.
