EBay Seller fees Iqor

the listing was in June, yes it was ages ago. I've been dealing with Iqor for around 2 months now, ebay no longer respond to my emails even tho' they send me reminder to pay my bill every month.
Just to clarify.
You are saying it is legal for ebay to claim a seller fee for an item they know 100% did not sell on their site simply because I could not follow the advice they sent me to raise an issue and despite the fact I made them aware, several times that I could not complete those instructions.
PS: It was well over 2 months, let alone 34 days before i was made aware of the outstanding fees in the first place.

When you list something it does tell you above the fee box (if listing direct on ebay) that there will be a FVF if item sells, the fee also appears in your account as soon as item sells, I would have thought that is considered sufficient notification that fees are chargeable on a sale.
The requirement is not for a sale that is completed, it is for a sale via ebay. If the sale is not completed for any reason then the procedures as outlined above come into place.
I do have one question, although frankly i don't think it is in any way helpful to you, is why were you originally suspended from ebay. My account was supended due to these unpaid fees.
when i was iriginally contacted by ebay I responded and they sorted out the refund on one item, as i stated. it was not until the next month had passed that i realised only 1 item had been refunded. whilst trying to remedy this over the next few weeks my account was suspended as I was refusing to pay for the reasons i've stated.
I hope this makes sense, like i said at the start, it's complicated.
another complicating factor was that i was told that the car fee had been refunded when in fact it was the fee for the bike, I spent about month chasing a refund for the bike which had already been granted, neither myself nor the ebay advisors spotted this, by the time I realised I was chasing the wrong item it had been about 3 months down the line, I couldn't raise an issue against the car as too much time had passed and hence this problem.
An Iqor advisor actually took me through to my accounts page on ebay over the phone, it was whilst doing this that we discovered this is what had happened. it wasn't until that point I knew I could still access any info directly through the ebay site whilst being suspended.

NPB: non-paying bidder.
You can raise an NPB on someone four days after the sale, so you could have done this very quickly after you knew the buyers were going to pull out.
If you were happy to cancel the sale with the buyers, then you should have agreed a mutual cancellation with the buyer. Sending them a notice and letting wait 7 days without an answer cancels the sale automatically; unless the buyer actively declines it this reclaims your fees.
Since you are given all this information on eBay - if you know to read things very carefully before you commit to anything, which is usually your responsibility - it is very definitely legal. What you need to do to win a court case is get the none paying bidders to verify what happened. It is still recorded as a sale on the ebay system, despite the fact they waived one set of fees. If you pay now, you still won't be able to claim money back. Also, as you are in contact with someone at ebay and are trying to resolve the matter, a court would probably let you go on with that process.0

The reason I asked about the suspension was if you had been suspended at the same time as trying to do an nPB it might have been a smidgen of a defence. However you were almost certainly out of time already to do any sort of formal claim for FVFs by the time of suspension so that knocks that on the head.

Yes I have all this in writing. It applied to the bike and they did refund me all the fees related to that item. I have never disputed that I owed the listing fee and i was happy to pay it. The only fee i have disputed is the seller fee. I have stated this in pretty much every letter and email I have ever sent to either company.
re. having a contact at ebay... I wish!! every time you email them you get a different person. I originally asked that my email could be handled by the original ebay services operator as she knew what had happened and how she'd handled it up to that point, I was told it was not possible but the new operator would look into it, they asked for all the info again. I get stuck in circles for weeks on end with multiple ops until it gets to the point I find myself at today.

ultimately I lose. I Pay for my mistakes and theirs and ebays.
from what you're saying (and you seem to know your stuff) I should pay this off and take the hit.
looks like that's the path I'll have to follow but i'll be making some serious complaints about the service i've received from both ebay and iqor. Iqor have been especially bad. Ebay customer services were as confused as I was i think!! hence chasing the wrong item for such a long period of time.
Which places should I forward my complaints to? FOS, watchdog, FSA (for Iqor) any others?

sorry, I was a bit vague there re my complaints...
I will address my complaints with ebay with ebay. the fact that they sorted one of the refunds outside of the usual channels but ignored the other item is still a mystery to me.
I was talking more about Iqor, I have addressed their collections manager directly on 3 seperate occasions asking for a written reply all i ever receive are calls from the monkeys demanding payment. I don't think it was ever unreasonable of me to expect a reply from the organ grinder so to speak.
their letters always begin with ' you have failed to contact us'. Wrong!! I've contacted you several times! I've checked them out on a number of forums and it seems they're well known for being a shower of .... I want to make sure my log gets put on the fire. I'll feel a bit better about it even tho this whole episode will leave a nasty taste in my mouth for quite some time.0
