    without wanting to go into it, it couldn't be a worse time really.
    If I can get some clarity from citizens advice or something like that then maybe i'll fight. I've never even had to get legal advice before, what do i do, just walk into a solicitors? sounds pricey...

    CAB would probably be able to advise better as to what to do.

    It's probably fairly clear what they will say, unfortunately I still think you will be expected to pay up, but it's better not to have us trying to assist when none of us have or can prove that we have proper legal education. If we say one thing and you take our advice and land up in even more difficulties, then it would be worse for you than paying for a solicitor's advice. If that is pricey and more expense than just paying what you owe, then you might just have to pay up.

    To me it seems it will very much depend on the wording when ebay said they would refund the 'fees' (note plural).

    If they said they would refund the fees on both items ebay do not have a leg to stand on. If it's only one item I'd doubt the OP has. If it's ambiguous you'll probably get the usual "it depends on the judge/how the judge feels on the day" response.

    If you are not a lawyer I also suggest we know your opinion as well and we leave it up to either the CAB or the solicitor who gets involved to sort the OP out.

    Indeed.

    It's just that when you say: "It's probably fairly clear what they will say" you're implying that you actually already know the answer and the whole point of getting professional advice is that the answer isn't clear cut. :)

    There is only you who have made a definite statement as to what would happen in court, not Azari. It irritates as you can see. If you had begun with the advice to consult someone qualified, it would be different.
    Not that I would expect this to stop you giving opinions you are not qualified to.

  • well, thanks for the advice everyone.
    I'm glad it's had some comedy value for some of you.
    The bottom line is it has made me have another look over all my evidence and whilst I am still certain I have a strong case I cannot risk the fact that ebay will claim they advised me to follow the proper channels and whilst I may have thought I was by dealing with customer services resolution centre and being successful in one instance. I was mistaken.

    sorry for those of you who thought I should fight but I can't risk not winning.

    I shall however continue to address the horrific service and tactics of Iqor.
    needless to say, I will never use ebay again for buying or selling but they have also not heard the last of this. I still consider them to be equally to blame for this 'Rigmarole'.
    mainly because they sorted one item out and not the other., that's double standards in my opinion.

    Stick to postage and packing bob. I know you're comfortable with that. Then find some advice I've given that is wrong. There is one.

    This issue is resolved now as I decided to pay.
    Just wanted to update you with the hilarious aftermath.
    I receive a message from ebay acknowledging payment and that my account will be re-instated shortly.
    Later that day I receive another message from ebay requesting I settle the outstanding account. This is after they've acknowledged payment!!! this is exactly the sort of imcompetence I expect from them so I don't know why I'm surprised.
    I emailed them back and told them, politely, they could shove their account and if they ever bother me again I will regard it as harrassment.
    following that I am sent a request to complete customer service feedback...oh yes, I completed that alright!
    a few days later I get another mail saying sorry you're leaving, you're a valued customer, what can we do to help etc, blah blah.
    Well, not a lot to be honest, you couldn't sort it out before you gave it to your obnoxious debt collectors so what makes you think I'm going to waste any more time on you idiots...enjoy your money that you've taken from me.
    My account is closed, I will be informing them that if they wish to make amends I require the return of my seller fees and my fees for printing letters, sending recorded deliveries and also for my administration charges at the more than reasonable price of £10 per hour @6 hours.
    I know what you're thinking...flying pigs, Freezing places where devils live, BMW drivers indicating!!! exactly...not likely.

    Ebay customer services, truly a legendary set of tools.
