They have people paid to just wear their victims down.

Azari, I appreciate you battling my corner but you may have misunderstood something.
there were 2 items that didn't sell. ebay only refunded the fees on one item. The outstanding item is the one that has caused all the problems but they never said they would refund the charges on that item directly. I have been trying to get them to do so and failed despite handling it in exactly the same way as i did the first. why they chose to refund one and not the other, I do not know. they were notified of both at the same time. same email.
I think they would argue that the refund only applied to one item.
I hope this clears it up a bit. thanks again0 -

the solicitors letter told me not to contact them, only to contact Iqor. it was in big black capital letters. would they not just ignore all the ifo I send them (there's a lot of emails between me and ebay) as Simon Williams at Iqor has done?0 -

As you stated in the OP that they said they would refund the fees (plural) but had only actually refunded one I took that to mean that they said they would refund both items but had only actually refunded one.
If they were clear that they were only intending to refund the fees on one item then that changes everything - at least as far as my advice is concerned.There are two types of people in the world: Those that can extrapolate information.0 -

You'd need to get advice from another solicitor (or the Law Society) on that.
I suspect that they work for Iqor on a fixed fee basis and the last thing they want is to have to do any actual work on the case. Whether a solicitor can simply ignore salient information about a case is something on which you'd need expert opinion - I doubt it would go down well in a court case, though, particularly if you have evidence that both ebay and the collection company were also ignoring you.There are two types of people in the world: Those that can extrapolate information.0 -

the only evidence that I would have is the fact that I have no evidence, if you see what I mean...
I have all copies of my letters and proof of posting and all my sent emails are in my sent box. apart from that I have one email from iqor this week telling me they have failed to contact me on the phone so I have to ring them.
every letter I have sent them I have told them that I want written correspondance and to cease the phone calls as they have not proved to be any use. I have stated that the operators are only interested in demanding money and they have all the info they require. I have spoken to their operators on the phone 4 times in total and every time they talk like they have no notes and I have to go through the full story again.
I was going to ring them out of courtesy after receiving the email but they've really wound me up by never responding to my letters.0 -

That would probably be good enough.
It's doubtful that ebay or the collection agency would actually lie in court about not receiving things - the best they will come up with is a lame "we have no record" and if you have made several attempts a judge will see that for exactly what it is.
Definitely time for proper legal advice, though.
You've got two options: Let them walk all over you or at least investigate whether or not it's worth standing up to them.
