EBay Seller fees Iqor

I have scoured through many threads about Iqor and their methods and although there are some similar stories to my own, I would appreciate some advice if possible.
This is quite complicated overall so i'll try to make it as simple as possible. here goes...

a few months ago I listed 2 items for a friend (car and a motorcycle), they were both bid on and both buyers pulled out, they contacted me and there was no issue. I was going to re-list the items but didn't. they sold elsewhere and I forgot about it until I got a demand for the seller fees. I contacted ebay customer services and was told I should raise an issue through the site but, on this occasion they would refund the fees and as a measure of goodwill, would not charge me for the listing either, happy days I thought.
the problem was they only refunded one item and continued to chase the fees for the outstanding item a month later.
I contacted them and told them that the item had not sold, I would not pay seller fees for something that had not sold but I was quite happy to pay the listing fee once they had amended my bill.
This never happened despite multiple e-mails between myself and customer services, they told me to raise an issue using the reference number but i couldn't, the site would not recognise the listing reference and my account was blocked, I told them this but they just responded by saying they had taken action against the 'would be' buyer but not what that action was. Surely this is an admission that they know the item did not sell through their site?
The next I hear is from Iqor, I explained why I would not pay to their operative and he agreed with me and said he would look into it. A week or so later I get another call asking when I'm paying, I explain again why I am not, obviously the first guy has done nothing! a week or so later I get another call, again, they want the money and threaten me it could go to court. I send all my documentation in to Simon Williams, collection manager at Iqor, my emails, my statements showing the refund for one item but not for another, all my communications basically between ebay. I ask for a reply in writing, I don't get one. I receive another call from iqor asking why I haven't been in touch. The cheek of it! they spout the same nonsense and I tell them I will not respond to their calls anymore as we are going in circles. I will only accept written correspondence and I am still awaiting a reply to my letter to Simon Williams. I Have since sent Simon williams 2 further letters requesting his response and telling his company to stop calling at all hours and explaining my reasons. I do not think that it is unreasonable of me to expect him to respond to me in a professional manner.
I have received a letter from the solicitors now stating that this is likely this will go to court.
I am prepared to do so, I'm confident that I have a strong case here. I don't think ebay or iqor have a leg to stand on, I have constantly maintained that I am prepared to pay the listing fee but the seller fees should not be paid, the sale didn't go through. I have all my evidence that I attempted to sort this with customer services and with iqor, yet they persist. I've invested much time and money already but i'm getting tired now. All my letters have been recorded delivery, I know they've been signed for.
I'm thinking that i should just go to court and let them sort it out.
the overall bill is just over 50 quid but it's the principle of the thing. they're basically trying to get money for nothing and I don't think it's right.

I'd be interested in any advice, I feel I've done all I can, and to be honest, with some of the things i've read about them and my own experience, I've probably done too much.

what do you guys think?

    It seems to be of your own making. Buyers who pull out without going through the process presumably? If it had been done the correct way, buyer requests a cancellation through ebay, then no problem.
    A court would have to decide if they believe you. The items have sold, outside of ebay. If you have proof of that, you may win.

    You do not have to pay final value fees on a failed fees, however, and it is a big however, you have to formally reclaim your fees otherwise they remain payable.

    You had two ways to reclaim fees, one would have been a mutual (and that does not guarantee your fees back if buyer declines) the other way would have been to do a full NPB. Unless the buyer had paid you would have been guaranteed your fees back.

    So, if you go to court you may find that as you simply failed to do the simple steps that were required for you to get your fees back you will lose.

    Personally due to the strong arm tactics that these debt collectors use and the very real chance this will reflect badly on your credit rating, I would pay and write it off as a lesson learned.

    ebay have already told me via email that they have taken action against the non-buyer. they are still claiming the selling fee tho'.

    Yes, you still needed to have formally reclaimed your fees on a successful sale.

    I never paid any fees in order to reclaim them tho.
    when I originally raised the issue with ebay, they removed the fees for one of the items by refunding them on my statement. why do one and not the other? by the time I realised this and the 2nd item had become a problem I was locked out of my account, all my correspondence was through the standard customer services channels.

    they just sent me a message saying they didn't want to purchase it. they decided they lived too far away to come and collect.
    The other chap rang my friend up and told him he had won another item so he didn't want to go through with it.
    i've bought and sold around 150 items over the years with no problems, when this arose I really had no idea what do do. I kind of got lost in the various pages of ebay's resolution services but thought I had managed to resolve it when the first set of charges were refunded, unfortunately I was wrong and i'm left with this small headache.

    A possible solution...

    If I pay these fees to iqor then I assume my ebay account will remain closed.
    If I pay the fees to ebay through my paypal account then my account will be re-instated. would I then be able to open a claim to recover my seller fees once my account is back open.
    i would still not be able to raise an issue against the item no. as it expired long ago.
    To be honest, apart from recovering my fees I never want to touch ebay again. this incident has put me off them for life. I just want to get this sorted. It is clear from your replies that you in fact think I am in the wrong, whilst I don't agree with you, I would be a fool to ignore your advice having asked for it.

    I assume all this happened a while ago? In that case you can no longer do an NPB as you only have 34 days (can someone double check that time frame for me please) to start the claim
