I'm not sure what all the fuss is about.

You have no right to an exchange or refund in this situation.

    End of.

By the way, wy didn't you try it on? (on both occasions).

Muffinmaker, you did not have a receipt. You had a receipt for an earlier item which was crossed out to show it had been exchanged, you did not have a receipt for the newer item. For all the shop knew, you exchanged the original item for a pair of trousers and shoplifted the second cardigan.

geri, because the T shirt smells of perfume doesn't mean it had been worn, plus I bet any tags were still attached Any shop caught selling items as new that were found to be returns would be dragged through the coals, as is often seen in the press when people find pics on their "new" computer/camera etc etc

The OP accused them of acting illegally, how is that not confrontational? I think the OP needs to take a long hard look at herself.
  • The cardigan doesn't smell of perfume. It is perfectly fine - it is just a bit small on the arms and doesn't feel very comfortable to me.

I wasn't confrontational - I didn't swear at the woman, nor did I jab my finger. I think you are being provocative by insinuating that I was. People who are confrontational are generally poorly educated and unable to articulate what they are trying to say and use bad language. Just because someone is a store manager it doesn't mean that they don't have an "off day", which I think this woman did and she was taking it out on me. I just wanted a fuller explanation of her reasons why I couldn't have a refund and she said that she didn't want to deal with it after a couple of minutes discussion. I don't know where you shop, eat etc. but that is not good customer service!

And I fail to see why asking for a refund is being confrontational. Why shouldn't you expect one - I had a receipt and I was not aware that the old receipt couldn't be used for an exchanged item - I've never been in that situation before. If everyone accepted the situation then there would be no consumer rights at all, nothing would ever change. We are far too accepting in this country - that's why we are "rip off" Britain.

You are not being helpful. Just negative and judgemental.
  • Oh dear I can see this getting a bit silly.

Maybe you should just cut your losses and put the cardigan on ebay, described as 'used' but only worn once;)

  • I find it so strange that people comment on consumer rights etc. but have no interest in helping the "consumer", just berating them for their unwise purchase. As if they've never taken anything back that they didn't want and with the best will in the world sometimes things aren't that straightforward.

I'll wait to hear from RI customer services because at the very least I don't think it was appropriate that a branch manager treat me the way that she did.

Cardie, will probably still be used if I don't get a refund. Ebay is too much hassle.

Like Julia Roberts says in Pretty Woman to that shopgirl "Big, Huge, Mistake" - I'll take my money elsewhere in future.

River Island must be devastated to lose your custom. The owners will probably kill themselves in despair.

    One thing is quite straightforward...

You have no statutory right to a refund unless the thing is faulty.

I am sorry you don't like the answer you have been given.

I'm not saying it's been worn, but I suspect it's been tried on. I don't see the difference between me buying something, trying it on at home and returning it and me trying something on in the changing rooms. I do not believe that if something is returned with the tags it doesn't get resold.
  • People return clothes to stores after trying them at home all the time - in fact I've often been told on buying an item try it at home and if you don't like you can return it, as was the case recently in Karen Millen when I bought some shoes. If shops didn't resell returned items as new then they'd have no stock left! And I did have the tags, they weren't attached. I've bought lots of clothes where the tags haven't been attached. And to attach the "kimble" tags you just use a little gun thing. And you can try things on in the shop and still get make up on them etc.
