    She doesn't need to write she can do that over the phone.

    One thing to consider is whether the form she signed was just and authority to repay, or whether it was a deed of assignment.

    A deed of assignment is a legally binding contract between you and the claims company. It means that you have assigned the rights to the repayment for 'x' number of years to that particular company.

    A Deed of Assignment can only be cancelled if both the taxpayer and the Assignee (claims company) agree and it must be done in writing.

    I would suggest that when she calls to have the Authority to deal wioth the claims company removed that she ask whether a Deed of Assignment is in place and if so which years that DoA refers to.

    Deeds of Assignment have become much more common over the past few years as unscrupulous companies such as this one (and many others) look to guarantee an income for themselves at the taxpayers expense.

    I got £156 back from the last three years, I have been a non tax payer forte last two years so they didn't count but its better then nothing...

    gladly accepted this side of christmas, although I have noticed some links for tax rebate on social media where the companies take a cut of the payment, just keep your eye out, it was easy enough done yourself with the forms I even sent all the previous years forms in the same envelope..

    Thank you for your reply, unfortunately she had not made a claim for this in the past and was cajoled into joining her friend from work who assured her that: "It will be fine!" So she filled them in there and then not knowing that there were better ways of doing it or referring to this fine site for valuable advice.
    I will tell her about your advice and get her to Phone HMRC as soon as possible to stop a repeat.

    Thank you, I will tell her about this and get her to act right away. She has lost quite a lot of money using this company so it has been a harsh lesson to learn, but it has been learnt!

    It's currently taking HMRC just under 2 months to answer letters so any such refund is likely to have only just been issued, 7 weeks is probably just about long enough for this to happen. When a refund is issued HMRC will send you a postal confirmation. All of these types of refund are issued as a physical paper cheque and HMRC print them in house. It takes about 8 - 12 days for HMRC to print the cheque and for it to be delivered to the nominee. They will have to bank the cheque and agree it to your account before sending out another cheque. This process will add another 2 weeks before your cheque lands with you.

    As such the most likely explanation is that the cheque is "in the post".

    Does she have a copy of the confirmation from HMRC? What is the date on that confirmation? If it's within 4 weeks she probably just needs to wait bit longer.

    If she didn't receive a postal confirmation you need to ask why that is. Has she changed postal address since she put the claim in or since she last informed HMRC of her address? This could mean her payment has been sent elsewhere.

    In any event the company won't look into it until she has allowed sufficient time for the cheque to arrive. If she contacts HMRC they will also tell her when the cheque was cashed and who it was sent out to. HMRC have had a lot of problems of late with clerical errors and sending these cheques to the wrong nominees which may also be a reason she hasn't received it.
  • My oh works in Precision Engineering, in January 2014 I wrote to HMRC explaining he had to provide his own tools, saftey boots and wash his overalls several times a week, I provided HMRC invoices to prove he bought his own tools and boots and they refunded my oh £480.00 for the past 4 years and he now gets £260.00 a year through his tax code

  • Sorry if this has already been asked but I can't find the information anywhere.

    How much do I put down on the claim form when it asks "Expenses Claimed"? I am only claiming for having to wash my own uniform.

  • I did read that but don't quite understand it, I worked in retail, none of the industries listed on the left of that link.

    I am assuming it is £60?
