  • I have tried to find the info i need from this thread but I have read a few pages now and it seems nothing to do mostly withy the thread title.

    Please could someone tell me: I sent a template form to HSBC in July 2010. They acknowledged, and sent me letter 4 weeks later saying looking into it, a further 4 weeks after that saying same thing and a further after that saying same thing. I now have letter regadring the court case thingy so I have to wait again, yet looking at some points in the thread that do make sense, HSBC is not mentioned.

    Is it a case or sit and wait again?

    FOS is business as usual though so you would now be free to take your complaint there.

    HSBC are definately one of the banks who have stated they'll put claims on hold - as marshallka says take your claim to the Financial Ombudsman Service, I'd also write to HSBC and ask them specificially how your claim has been affected by the Judicial Review, you're also at liberty to contact your MP and get him to write to the CEO of HSBC UK to ask why they're breaching FSA rules on your claim.

    the otherside will only pay the Court Fee and the fixed costs for solicitors to list the claim - these costs are fixed by the Civil Procedure Rules - (Practice Directions 43 - 48) which govern the Civil Courts in England and Wales - what the banks won't pay are solicitors or cmc fees - unless of course the claim is over £5000 and has not been allocated to the Small Claims Track in the County Court - then if it's outside the Small Claims Court you risk having to pay the othersides costs if you lose.

    If anyone's interested Civil Procedure Rule Part 54 covers the rules governing Judicial and Statutory Reviews - I suspect the application being heard in January is whether the banks have 'permission to proceed' under Part 54.4

    The court’s permission to proceed is required in a claim for judicial review whether started under this Section or transferred to the Administrative Court.
