    Got to agree here, OFT might do something, BPA won't. As long as it does not change the governments idea that ppc's are regulated sufficiently, we don't want them to have any more regulation, we may not be allowed to ignore the tickets anymore.
    I stand by my suggestion on the BPA thread I opened; write to your MP
    If it moves; sue it!
  • To keep it short..i went down to brighton for a big motorcycle event last sunday 10/10. I trade at these events,and as the set up time was 6am sunday I left home in manchester at 8.00pm sat night. pulling my trailer behind my 4x4. I got to Pease pottage services ( MOTO) at 11.21 as shown on the photographic evidence on CP PLUSs website !) I was knackered,so decided to grab an hours sleep or so,before heading on the 20 or so miles to Brighton..my intention was to stay there until i could access the site..but i was so knackered..i slept until 5.00am..so pulled off the services and was on my way..refreshed. On saturday a recieved a PARKING CHARGE NOTICE from a company called CP plus parking demanding £50 or £80 if not paid by 27/10. I was fuming..as unlike a lot of folks who DO abuse service area car parks and leave thier car all day whilst car sharing etc..i was genuinely tired,and heeded the overhead messages " tiredness kills..take a break" ! Anyway..i emailed MOTO and got the standard reply that they would forward my complaint onto thier car parking company !! so i simply told them a few home truths about "PCNs" and how the company they were using were no more than cowboys..and also said that if they couldnt prove that I was driving at the time of the alleged "offence" that there was nothing they could do..in other words ..made a bit of noise and threatened to expose MOTO as being cowboys..and they have just quashed my ticket !! I cant say this will work in every case..but its very true that unless they can PROVE you were the driver..they CANT take it further. Only the police/traffic wardens can issue a ticket against the registered keeper of a vehicle i,m led to believe. I actually called CP plus parking, who are based in Borehamwood, and asked the guy who answered the phone " do you work for a local authority" ? he replied no..but worked for the landowner..and I also asked him if he could prove that I was driving? to which he also replied,No..the photographs of me entering and leaving was in darkness. So thanks to advice i got from this forum yesterday..i dont have to pay up !! Cheers fellas..power to the people !!
  • I have just recieved a parking charge from 'athena ANPR ltd' for overstaying at Lidl car park for 16 minutes! I have been googling and looking through hundreds of websites all saying to ignore this.

    I'm just wanting a few questions answered as i'm quite unclear on a few things:

    1. If i am to ignore the letter will this affect my credit rating or make any kind of black mark against my name?!

    2. They do have signs up and i did overstay - so why am i not legally obliged to pay?

    I'm just worried that if i do ignore it there will be a future consequence for myself.

    Hope you can explain it simply for me as i'm just not getting it!

    1. The only way it could affect your credit rating would be if Athena took you to court, and succeeded with their claim, and you didn't pay the judgement within 21 days. About as likely as you winning the Lottery two weeks running.

    2. Regardless of what their signs may say, in English law a party can only sue for actual losses arising out of breach of contract. Since this was a free car park, their losses from you overstaying were £0.00, unless they can prove that all other spaces were full and customers had to be turned away.

    Ignore this, nothing will happen, other than a series of increasingly threatening, then desperate, letters.

  • Just listen to what the hundreds of web sites say.
    They cannot affect your credit rating unless they take you to court (which they never will) you lose the case (even less likely) and fail to pay whatever the judge decides( this would just never happen)
    There are lots of posts on here about Athena and Lidl, take a look.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
