We've been gazumpedWe can up the offer a little bit, but not much (OH is refusing to budge). It's really annoying as we've just paid the solicitors upfront fee - then get a call three hours later telling us someone else has come in with another offer
The agent was annoyed too - it's up with two agencies - and the higher offer has come from the other agency.

Solicitors fees - not sure how much they can charge us as they hadn't actually done anything as we only paid the down payment yesterday lunchtime (£300). The actual fees would be another £700 on top of that; but I am not sure what is owed at the moment probably the whole lot.
We will try again with a higher offer when the EA is open, but I am not holding out much hope. OH is very stubbon and will not negiotate on things like this. We can afford to raise it, but it's just a bit of a pain as the mortgage application is already in so either we ask them to rejig the figures or we find the extra from somewhere in cash (which would be okay as we would complete after payday). We'll see what they say. I like the house but I know there will be another, so it's not too bad, it would just be annoying as we've already started to pay for things.

The Solicitors shouldn't charge you if they haven't done the work. When my sale fell through earlier this year, mine offered to charge me half for the work they had done (£90 instead of £180) if I found another property and used them again, which I was happy to do.
Is it a proper firm of Solicitors or an online service?0 -

I'd talk to your solicitors asap - it may be difficult to get the money back from them, but if you are planning to buy a house at some point, it wouldn't be unreasonable to ask them to hold onto the money and use when you instruct them in the future.0 -

We are STILL waiting for the local search results to come through. Apparently the Council "made the information available" to the agency on Thursday but the solcitors haven't received anything yet. So frustrating! We really want to comlpete by the 21 April but it is cutting it a bit fine now!! :undecided0 -

It's a proper firm; but one through the EA - so not local. I asked the EA and he said he would check for us as sometimes they hold onto the cash if we want to buy something else through them.
We had filled in the initial information forms and returned the stamp duty declaration - but nothing else has been done; we only authorised the payment a couple of hours before we got a call from the EA to say we'd been gazumped, so no searches had been started and no draft contracts drawn up.
I will pay what it owed if we don't get it, I have no problem with that - we knew it could happen and it was always a risk; I'd just really hoped it would all just go through.
I have put a higher offer in so I am waiting for them to get back to us (EA doesn't know what the other offer is as it with a different EA) - we might still get to go ahead, but we won't know until they call us. Aww that's crappy news Celyn, hope things work out for you whether you decide to up the offer or walk away (and find something else instead). Your solicitor should be able to hold the money on file as mentioned before, for your next purchase - just call and explain the situ...having said that you may be able to snatch the house back. It is harrowing though, would hate to be in that situ.
