No everything was done through ebay/paypal, it showed as sold and had my money received in green writing then shortly after the collection, ebay sent the hacked account warning and said they had removed the listing, but previously it had showed as sold, I had listed the TV twice it showed 1 item unsold and 1 sold then after they sent me the hacked account message even though it had showed as sold, they unlisted it and it only shows 1 item unsold.

OK, thank you for that. I Just wanted to be clear what I was looking at.

It is quite rare though that ebay pull a listing when it is the seller that has been scammed, usually they only pull them when the seller is a problem. Did you get your FVFs reimbursed?

  • Yes they removed the fees, but I was happy to pay the fees, I really need the money.

Then I think you are back to trying to get someone with some clout, and some influence with the press to help you. Or continuing to plead with paypal for a goodwill gesture, you could use the 'ebay have removed the item as i was scammed' to help plead your case.

If you think it's illegal, you can bring a test case to try it out.

You pay eBay to find you a buyer, the risk is all your own.
There was a case where a postmaster challenged PO Ltd after a robbery. Long story, but they tried to make him pay as he had answered the door in the small hours. The judge found in his favour, quoting "any organisation participating in the profits must also participate in the risks no matter what the contract says. Such a contract is clearly illegal".
Not aimed at you, but people do tend to become defensive about things like ebay and paypal when they are criticised. I agree paypal is a great idea for both buyer and seller. But there should be a choice to use it or not.

Well this pretty much my point, ebay set this scam up, ebay and paypal have now profited from it, but I have lost my TV and my the money I expected, as far as I was aware I did the sale as ebay/paypal requested using there systems all done officially ok I did not read the small print as all communication other than arranging the collection by phone and a couple of text messages was done through ebay and I am sure they can check this.

I have a sent text message saved where I request payment upon collection and a received text message that states ("the buyer") I will pay via paypal, could this help my case?

I would have thought a business with 20 mil going through it a day could afford to cover my loss but they still do not seem to be showing signs of concern.

They have promised I will get a call today but that was a couple of hours ago and I doubt they will call after 5.30 so again they are putting me under more unnecessary stress.

You cannot hack an account if it hasn't been used for a long time, you have to get the login details from somewhere (unless you guess right).
Also bruteforce attack is not an option with ebay as they lock your account after a few failed attempts.
