I just wondered if any one could help, my partner (we don't live together, we have separate homes etc) has his bankruptcy appointment this week. He has a visa card which is on my account and each month cleared by me. He has this for emergencies etc etc, not for living it up. So how will this be viewed does anyone know ?0

First of all you cannot have a joint credit card. It is your card with your partner as a registered user.
However, since the terms of the bankruptcy state that you must not obtain any form of credit whilst undischarged, I don't think that the OR would view this very kindly at all.
It may be better to cancel your partner from your account, until he gets his automatic/full discharge.0 -

The worst culprit today has been Capital One. I have made a note of the times that they have called today and I will send a letter in the morning, about all of them, to the OFT. Along with a complaint about all the other companies too.
It is illegal for them to harrass folks like this. Also, in that letter I sent I requested contact by letter only, and that if the phone calls persisted, the matter would be reported to the OFT. So now I am doing it!
I do have callminder, but it is the incessant phone ringing that is maddening.
This is the letter that I sent out three weeks ago -
Dear Sir,
Ref.
Originally I informed you that I had taken debt management advice. I am now able to tell you that my debt management will be sorted by 20th November and you will hear from my debt management company in due course.
Thank you for your patience.
Furthermore, I am writing to you regarding the above account and the daily calls i am receiving several times a day from yourselves.
This behaviour constitutes harassment; this letter states quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, has now been submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.
I trust that I have made myself understood on this matter.

p.s. i have my answer phone on speaker phone, and prefer this to call minder as it means i can hear who it is, also it kicks in after just two rings. only thing to watch out for is to make sure you take it off speaker phone when you have people round!!!...not very nice to have some condescending debt collector leaving a menacing message in front of all and sundry...!!:o0 -

I am really concerned about the possibility of losing my old cars , one I can live with , is there any way legally that you can keep them ? is it down to the OR on the day ?
Has anyone else been faced with this problem ?
they are everyday useable classics but are not sought after cars at all only within Marina fan club circles .no 28 BCSC Member:T

Since your cars aren't worth a whole lot of money, and wouldn't raise much money at auction, I tend to think that the OR will let you keep them. Maybe you could dream up a reason why you need a car each? Just in case it is questioned.0 -

You have to declare your bank accounts and accounts that you would have an interest in , ie your wife's account. It might be best to either put that account into her name only, or to get her to open a new account and close the joint account.0
