Also, if the OR freezes the bank account, if a DD is due to go out, does this then get denied by the bank?
Your mobile phone contract should be unaffected by bankruptcy, unless it is one of your debts. Provided you don't have a ridiculously expensive tariff and you need your mobile for work, the OR probably won't question it.
If your OR freezes your bank account, yes this will mean that DDs are refused by the bank. You should seek alternative ways of paying, or open a basic bank account that is unlikely to be frozen by OR.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Hi
First post here as have had light bulb moment this week and realised I dont have much option but to go BR due to cc and loan debts totalling £27,000 approx. Have filled in online the CCCS stuff and it was their suggestion - or 23 years on an IVA!!
Head still trying to take it all in.Loads of questions, some helped by reading earlier posts on this forum, thanks. But as we rent house from HA we dont actually own a great deal. We dont have a car worth over £1000 (though we do have more than one) and wonder what does the OR take from you to sell? One car old enough to be tax exempt but probably not worth £500.(Both Morris Marina's) not worth a lot. Another one we tried to seel on e-bay twice this year and didnt get the reserve so probably not worth £500. And my wife uses a 10 year old Vectra not worth £700 but registered in my name .
Both old cars on classic insurance total less than a modern car, but limited miles, hence the 2.
Does the OR tell you if you have to get rid of the internet? It is part of our package with NTL for tv and phone too. It is all a real big headache as we seem to be foundering trying to get answers. In fact we dont really know all the questions either at this point.
Would welcome a bit of advice from anyone who has been there/ done that.
Regards

hi
we found that it wasn't the OR that froze the account, that it is the bank that freezes it because they panic incase you owe them any money.
when we did it barclays froze our account and transfered £4.10 onto our barclaycard (which we thought we had closed two years ago ) we phoned them and they transfered the money to our new account and then promptly closed the account.
hope that is some help

Hi MWT - Firstly, do you mean 23 years on a DMP? IVA's last only 5 years and have very similar implications as bankruptcy, in that they are managed by an Insolvency Practitioner - if you default on an IVA then the IP can have you declared bankrupt.
It is possible that OR will see your old cars as unnecessary and may take them from you.
I would think that your NTL internet is okay.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

True sev, although the OR will tell you if you can use the account - I had to give all cheque books and debit cards to my OR and she told me not to use the accounts.:beer:I am NOT, nor do I profess to be, a Qualified Debt Adviser. The process is that the OR informs the banks that you have gone bankrupt, the bank will then close your account. However, the OR also tells the bank if he has any interest in it. With basic bank accounts the OR will tell the bank that he has no interest and it is kept open. Also, if your pay and/or benefits go into a bank account and you are in credit, the bank does not have to close the account but can revert it to a basic account and remove the overdraft facility.0 -
