Will the judge see me in a bad light if the reasons for bankruptcy were overspending albeit a lot of down to stress and depression from bullying in the workplace and outside? will I be seen in a better light due to the fact that I did try an IVA for six months?

    It wont even be mentioned....

Dont get too involved about what they may or may not say.. As long as you are telling the truth.. then there is nothing at all to worry about . Rog2 & others will stand by me with this...

What will the judge ask me? Will he ask me to justify the fact that I want to go bankrupt as opposed to an IVA? A friend who went bankrupt told me to tell them that you just cant meet the payments each month so it would unsustainable for 5 years.

The judge wont ask. Its not his job.

He will simply ask if you know what you are doing, ask if you have had professional advice and who from, ask you name and employment .. thats all... No ins and outs.

just let me check before I do this, a computer programmer doesn't lose his jobs through this?

My friend told me that he was asked by the judge for the reasons for going bankrupt? Surely someone asks along the way? Or willhe just look at my IVA proposals for the reasons?
  • Unless its inb your employment contract, No.

The judge may ask for an outline, simply tell him your debts are overwhelming, you have tried all solutions and this is now the best route. Your worrying too much. I know its easy to say as its nearly over for me.. But honest, its not as bad as you think.
