    Can I Just Clarify Something

If The Only Income They Take Into Account Is My Income Support And Incapacity Benefit Means I Get £351.80 Per Month

    Outgoings

    £50 Rent And Water
    £5 Council Tax
    £60 Gas And Electric
    £100 Food
    £30 Phone And Broadband
    £80 Childcare
    £20 Weight Watchers

That Would Leave Me With £6.80 Surplus Income For Incidentals Haircuts Etc

    Is That Right ???

The idea of going bankrupt is for you to sort your life out, to cut out all unnecessary expenditure to make a fresh start.

You are going to have to look at ways of cutting your household expenditure, since, from the figures you have provided, even after bankruptcy you will not be able to afford to live. You did not include your hairdressing bills, your cigarettes, other entertainment, etc. Nor did you include any money left over for Christmas, for essential clothing.

How are you expecting to make a fresh start with all of this?

Have you visited the https://www.insolvency.gov.uk site yet? That gives you some really good answers to questions, but only in brief. The online Statement of Affairs forms are to be found there too - under "Do it Online" , which is the best way to do it, I think.
  • hi would like to know what happens with this my OH has no bank account his wages go into my account what will happen when he goes bankrupt? I am so glad there is someone out there thank you

I take it that OH is employed and not self-employed?

If his wages go into your bank account and the account is in YOUR name only, then the OR will have no interest in that account.

The question on the SoA form asks for bank account details in the petitioner's name, or joint accounts held. Then it asks if salary/wages/benefits are paid into this account.

    Hope this helps!
  • Well To Behonest I Have My Ctc , Chb And Dla's To Use For The Things Not Mentioned

  • Where is the best place to get the forms? If I (and OH ) fill them in online, do we then have to print them off? Or is it best to get them from the court?
  • Hi
You can go to https://www.insolvency.gov.uk and fill the forms online. You can do this at your leisure(!). By that I mean you don't have to fill them all in at once. You can save the bits you've done and come back later. I think they stay live for 6 months.
DO NOT print them off untill you are ready to go bankrupt as you won't be able to change details.
I took 6 weeks to fill mine out and I did change a few things
The site is really helpful and fairly straitforward
    Good luck
Don't let the past become your future
