I am filling in the credit cards section, and it asks for date obtained.

Is that the date you obtained the credit facility, or the issue date of your latest card? 'cos it looks REALLY bad when you look at it, 'cos most of the cards are recently issued, but the accounts are years old.

    Hope that makes sense.

It is the date you first obtained the credit facility!!

That date, if unknown, can be found on your CRF, although a rough guess as to the year will do. What the OR is interested in is if the credit card was applied for in the preceding six months to the date of the bankruptcy.

    Don't worry about it!

Its credit gained in the last 2 years rather than 6 months.

When I filled in that part I put "don't know" in the spaces for dates I actually didn't know. There was no problem with that and no one said anything about it.

Officially, on paper, yes it is two years. In practice they take a lot more interest in the last six months!

There will be some people who fully intend going bankrupt who will take out extra credit one way or another just to make the most of it - I know that they represent a very small percentage of total bankruptcies but it does happen.

Look at some of the questions we have had here about being able to write off their debt with no consequences?
  • Hello!
As usual, I'm confused! I'm filling in my forms online now as it seems so uch simpler. I'm looking at Q 3.7 in assets which is about your car. But in brackets next to the question is states; 'if you own a motor vehicle this should also be listed in Q 3.1'.
Ok, fine, but where? Not one of the sections in 3.1 is headed 'car'. Am I just being dumb?

    You're not being dumb!!

But enter into 3.1 anyway in whichever bit seems most appropriate. It asks you to, so just do that as well.

I can't remember the heading I have placed mine under.

The car goes under "machinery, plant and equipment"

These forms are really set up for people who are self-employed who go bankrupt - that is where the confusion lies!

So... Officially yes, so thats what they look at. We shouldnt be saying 6 months on here when the fact is 2 years then. Mine got scrutinised for 2 years.

There is a bit specifically for cars I believe ?
  • Ok thanks!
    Another question though!
My partners daughter stays a minimum of 2 nights a week, should I mention her in the 'dependants' part? I wasn't sure whether to or not, but her being here does affect my soa. God, that sounds horrible! What I mean is, she eats like a horse and grows too fast! My partner has to pay £50 a week to the CSA for her, which is why he had to go with a debt management company in the end.
