Im new to this thread but not the forum.
I currently feel like Im staring Bankruptcy or "Sequestration as I live in Scotland"
down the Barrel of a Gun!
Im suffering from all the illments ie Sleepless nites, can,t concentrate on my job, isolated, guilty etc the list goes on.
My questions are:
Is there any member out there who,s been through the process of BR or SQ in Scotland ?
How did you find it?
Are the general procedures rules, laws the same as in England and Wales?
Are they harsher in Scotland?
Ive checked out the Scottish Insovency Service website so am aware of Temp and Permanment Trustees etc.
On a different note in regards to housing have any BR or SQ members rented property privately whilst BR or have they found Brickwalls going up down this route?
As obviously if I go down this route my future housing is one of my main concerns.
Thanks in advance for any help in these matters and just somewhere to go to ease the burden.
Yours Lone Traveller.

Hi Lone Traveller
to answer your questions we sequestrated ourselves last year
we paid a company money (which was a silly thing to do) -but they did give us invaluable advise and they filled in all the papers and found a Trustee for us. The cost for BR in Scotland is £63 - and you dont have to appear in court - our papers where filed at the start of October and we where declared BR at the end of October.
As you are up to date with all of your payments you may find it difficult for you to declare your BR as you need to have has Charge for payment or a Statutory demand served.
Our largest creditor (with an unsecured loan and o/draft) was the same bank with which my mortgage is with - we had no arrears and have bought out the "beneficial interest" from the Trustee so the house is safe. My OH had to have a third party buy out his "Beneficial Interest " in his soon to be ex-wife home as legally he still has an interest and it was estimated at £25k
If you want any more info just ask

Well, I have to go for an assessment day now - waiting for the date.
In the meantime I found another company that operate exactly the same way, same job, same conditions, etc, so I have two irons in the fire!0 -

It DOES take time Mike, but remember your br debts are no longer your responsibility and any correspondence of this type should be passed immediately to your OR who should deal with them for you.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
