    I posted on here a little while ago, but have been so busy I haven't had a chance to come back!

    My bankruptcy date is this coming Tuesday - my H has been paid today and is going to withdrawl the fee out of his bank on his way home and then we're all set!

    But I now have a worry! One company have been relentless with their phoning - every day, at all times, so I've been avoiding their calls as they're also really really rude to me on the phone and I always end up in tears (I'm 7 months pregnant which doesn't help). Anyway, they've now written saying they're going to send a local debt collector to my house within the next 7 to 10 days to collect full payment - well they dont have a chance in hell as unfortunately I dont have £15000 just lying round the place, but where do I stand if someone turns up at my home before Tuesday?

    Once Tuesday has been and gone, I'll quite happily phone them to tell them I'm bankrupt. Bit worried about phoning them now and telling them before it happens incase they send someone round quicker.

    Roll on Tuesday is all I can say!

    I can almost guarantee that they will not send anyone to your home.

    First of all, by law, in order to send a Debt Collector to your home they must first have obtained a CCJ against you.

    Don't worry about it.

    Is it MBNA by any chance?

    We would very much like advice on how to deal with the MBNA/RMA hound dogs but first can we give you some background to our situation? My husband and I are really relieved to find this website and after reading this thread over a couple of days have now decided to pluck up the courage to deal with our situation. So this is the first time we've done this and it hasn't started well - we missed spelt 'Apocalypse' which kind of shows you were we're at right now!

    First of all I have to say that if someone hasn't experienced MBNA then they have no idea what an underhanded operation they run.


    I reported MBNA to the OFT, who referred me to the TSO.

    I reported MBNA to the TSO, who referred me to the OFT.

    I lost the plot with both of them. I have now laid a formal complaint against MBNA with the FSO.

    MBNA are operating outwith UK Law and if the Governmental bodies of this country do not do anything about them they will simply keep going.

    I am going to get MBNA if it is the last thing I do. Read back at Rog2's messages - he has had the same problem as myself. If you read any of the DFW threads, many many people have a lot of trouble with MBNA. It is illegal and it is going to stop.

    No its not MBNA, its a debt collector working on behalf of Intelligent Finance.

    I just cant wait for Tuesday to be here so its over and done with.

    Am I right in thinking that all I need to take to the court is my bankruptcy form, and then the OR requests any paperwork he needs to see?

    yes all you take to court is your bankruptcy forms the OR will send you a pack with various forms and a list of what to send .

    Hi alidadas, one of my loans were with IF they sent me those as well, don't worry about them........

    Well you guys as no-one remembered :rotfl: I have a new piece of paper in my hand with a lovley stamp on it, yes thats ok I'll forgive you all :D: I am now officially bankrupt.

    my account of this morning,

    sat in waiting room to be called, went with nice lady to a desk, she checked through my forms and took the OR fees.I then had to swear oath. Then I had to go back to the waiting room for 25 minutes, she then called me back in and the judge did not need to see me, it was done.

    Then i spoke to the OR and he asked a few questions, like confirm my name etc and asked about my current bank accounts and I am only allowed my cashminder at the moment. He said i would recieve a letter about a telephone interview and then will more likely because of my reason 'gambling' will have an interview in approx 2-3 weeks time.

    That was it, in a way I was a bit dissappointed I was hoping for a lashing :D

  • Sarah, thats fantastic! I'm glad it wasn't too scary!!
    I'm starting to get nervous about Tuesday - mainly because we thought my OH would be able to get the morning off work to come with me, but thats looking unlikely now so I'll be going on my own. I'm not familliar with the area so will be nervous enough driving there - plus I'll leave mega early in case I get lost and also because traffic can be really bad round here in the morning! Must remember to take my book!
