Beware Belmont Thornton claims company

  • Hi, any advice would be appreciated. Nearly 3 years ago we contacted B/T (stupidly) and completed some claim forms. They sent us a cheque for a couple of small credit card amounts and we paid their fee. We also had some claimable PPI on a loan. The claim form was completed and returned to B/T. After several weeks we received a letter stating we were due this money and to sign an acceptance form which we did and sent back by return. Weeks passed and I kept chasing B/T they kept telling me the loan company were dragging their heels. I eventually contacted the loan company who told me nothing had been received by B/T and that their offer was now out of date. The loan company told me to cancel the PPI claim through B/T and advise them that we no longer wished to use their services nor did we wish to persue the claim with B/T which I did over the telephone and in writing. 18 months later I received an invoice for a % of the PPI which was to be paid to B/T ~ but they never claimed any money back for us from the loan company. I contacted them and said I wasn't paying for something that is not had from them. I never heard another word until 3 weeks ago when I got a phone call from them telling me I owed them money. I relayed the whole conversation and the chap said that's fine I'll close the case. Today I received a letter saying they were unable to close the case as I still owe them a management fee !!
How can I tell them to "shove it" legally and are they just trying to put pressure on me to pay? In the letter they also state they have contacted the loan company but I've not given them permission to request details about my account recently - can they do this? Thanks

I have used Belmont Thornton to claim back some charges.
I still had a loan with the company i claimed from, and they took the money straight off what i owed them.
Because the charges were claimed back using belmont thornton, i have to pay them a fee, even though i didn`t see none of the charges i`d won back.
I am with a debt management plan, so this is just another debt i`ve got.
No where on their forms does it say that the money you win, may not be given back to you and used to pay off any debt owed.

If you check the frequently asked questions on their website it states that they do not deal with people who are bankrupt, have an iva or in a debt management plan because often the refund is paid off what is owed on your loan or card etc leaving you with the extra bill of their fees. You could try and argue that they should have not represented you in the first place because you were in a DMP.
