I hope this gets sorted soon OP.

I have an Ipod nano 5G and it doesn't have the user's details in it. I know there is a contact list or something on my Nano, but have never used it. But you'd have to put in details manually.

I only have "Heather's Ipod" showing on the menu as I've changed it to say that.

Was it an Ipod touch? Hence the woman asked for an Iphone or is it a Nano? You would have to be careful as well if the Ipod is attached to an Itunes account, I am not sure if the woman would be able to purchase music using the account, I don't really use the Itunes store, so not sure.

I can't believe that JJB have been so incompetent in not asking this woman for any proof and just giving it to her!

A lot depends on how the ipod is set up, mine syncs with my MacBook and automatically puts any contacts I have stored onto my ipod.

Ah right. I don't use it for contacts or anything so I don't know. I only want my Ipod to listen to music or the radio.

probably worth going into it and storing a "Home" contact, should anyone honest find it they can then get in touch :D

A similar thing happened to my kids two or three years ago. We were staying with relatives in Bath although we live in the midlands and my oh had taken the kids to the park. We had recently bought all three children a ds for christmas (the most expensive things they ever had) and had them in our bag to occupy them during the long car journey home. My oh left the bag in the park! When he went back just a few minutes later it was gone but had been handed in. However the park info place had already given it back out to a couple of kids. It turns out they were close by when the bag was handed in and the park attendent went through the bag to try to id it. They then had gone over and said it was theirs and were given it without any checks or details being taken. The lads who originally handed it in were still there and able to give a description. The police took it seriously, talked to the park attendent and my oh, gave us a crime number and amazingly several months later we had a call to say that they had recovered one of the ds and as we had given them details of it previous they posted it back to us. We found that our home insurance didn't cover us away from home - it does now - and our kids still manage with sharing the one that was returned.

Thanks Abbafan. I don't know what kind of ipod it was...I don't understand those things, being a more mature lady!!! Though I must say I've learned a lot about them since posting this thread. When my son gets home this weekend he will know as he still has the receipt for the ipod and presumably set it all up for my grandson.

Sunnth, it does look like a very similar incident that happened to you. And if the police took that seriously, there's really no reason why they shouldn't also look into what has happened with my grandson.

In fact being given the excellent advice on here has made me determined to get some kind of result from the police or JJB, because otherwise I'll be left feeling that we've been unfairly fobbed off by the lot of them.

You shouldn't have to make a fuss to get taken seriously by the police but if that's what it takes I'll do it. Thanks again.

The distinction is that JJB did not seek to keep the iPod. It was given to another person in good faith under the honest belief that that person was the iPod's rightful owner. That is a different scenario to that in the article, where the question is whether a person who finds property belonging to another can keep it for themselves. JJB did not make an attempts to keep the property for themselves here.

Taking 'reasonable steps' to establish the identity of the owner would form part of the analysis into whether the standard of care had been met, but as I said above that standard is not very high here because the bailment is not voluntary.

    they took NO steps whatsoever

& how the f*ck can you mistake a £150 ipod for an iphone?
    they look nothing alike whatsoever
you could even phone the iphone to find it

    1) they should not have discussed the lost property in a 'public' area
    2) they should have made some record of the item, even just a note in the till
    3) anyone claiming the lost property should have been asked a couple of questions about it

JJB in that store have been negligent
they are a large business, they WILL have a lost property policy.
    that store disregarded the policy

I would send a letter to the store & head office informing them that you have been to the police, & that cctv & all other records have to be retained.

Thanks edgex, that's exactly what I thought. It's ridiculous that JJB should've just handed the ipod over when the woman asked for an iphone...surely that alone should have made them wonder how genuine she was?

My son did actually contact Head Office and at first they said they'd investigate, then said it was not their problem and they wouldn't help. After that they just ignored all my son's efforts to contact them.

He will now contact them again outlining what you (and others) have suggested. It's very obvious you're right and JJB have seriously messed up here, and the police haven't been much better.

Lifes little knocks make us up grow and learn. The lad should learn his lesson and chin up.
Society, corporations and government institutions cannot be held responsible for everything that happens in life.
Granted the woman who took the ipod is a thief. Granted JJB have made a mistake. Granted the police have resources to manage and granted the lad has matured by losing something but honestly can we really expect something for our own negligence?

A child will lose things. A parent will buy things for their children, what parent would not? But the question is, if you attach X amount of emotion to a particular product then why was X amount of responsibility not attached to having that product. I mean the loss has clearly upset the OP but the same level of thought and attachment should of been attached to teaching the child into acting responsibly. Yes, the child is 11 but so - why buy an 11 year old something that will cause X amount of emotional de / attachment.

It is through these very attitudes that the police investigate petty squabbles and crime. It is through these very attitudes that there is an industry of claim culture. It is through these attitudes that parents promote the 'want' of the expensive trainers, phones etc.

I think it is awful that JJB have to now reprimand one of their staff who was acting in good faith. Now a new piece of paperwork will be created for an employee and a telling off, perhaps a sacking? Who knows. All because an 11 year old left his toy in a shop.........

Good faith? He acted irresponsibly by passing something over without a second thought.

I think it's awful that JJB say the situation is closed as far as they are concerned.

The employee should be reprimanded at the very least, it might make him use his common sense next time.

It's digusting the way JJB have acted over this whole situation.
