My Item Stolen From Repair Shop - What can I do?

  • They asked for a written response in their letter, so I feel its only fair to give it to them and provide justification, and see what they say.

    I'll give them til the end of next week and then file with the small claims court

    Still feel post21 holds true and that you should be filing now, including this in your letter, if you still send it.
    More important: all your letters should include a required reply date - then stick to it.

    Hi guys,

    Here's the latest update. They have rejected my claim letter saying that i have listed the more recent version for comparison (the MK2 not MK1) and disputed the amount of depoists paid. They offered me £250 which is way below what I want. I spoken to consumer direct who advised that I should write to them rejecting their offer. So here's what I have drafted:

    Thank you for your correspondence regarding the above matter. I am writing to you to reject your offer.


    Firstly, your comments that the items I have listed are for CDJ1000 MKII’s is incorrect. As can be clearly seen in some of the item titles (such as PIONEER CDJ 1000 MK I), item descriptions and images located in the item listings, they are clearly CDJ1000 MK1s.

    Secondly your comments regarding the receipt are also not true. £80 deposits were paid. This is the same style receipt that was issued when my Technics SL1210 MKII turntables were brought in for in for repair.

    I think your letter is roughly right, in that you are submitting evidence of the value.

    But where it goes wrong is at the end, you leave a strong message that you could be haggled about for months to come.

    This is more than a matter of rewording. You need to state the level at which you would settle - and state that the matter will go to court if they do not settle within 7 days. Put a short deadline on it and stick to it.

    Like a fool I didn't put a date on because I didn't get your message until after I had sent the letter. Its been a couple of weeks now... do I file or send them a letter with date?

    Hopefully, you've already done so, using your certificate of posting at least as a proof of date origin.

    It's unbelievable the lengths some will go to avoid paying up. You have been more than patient and I think they have played on this fact. Do keep us up to date with how it goes, and don't let them wear you down:j
  • Just a quick update, the defendant has not responded to the claim from the court, so I have requested a judgement to be made.

    I'm guessing it should go in my favour, can anyone advise on what the likelihood is I'll get my money any time soon?! what's the process?

  • I'm in Scotland, so its maybe different but when a judgement went in a relatives favour they still refused to pay up and this was a high street shop.

    Got to the stage when there was an order from the sherrif court to seize goods from the shop. When the ballifs turned up the cash was quickly found although now it also included all sorts of fees.

    Be persistant and if they are not playing ball make sure they dont get off easily. You may not get your money but they wont want baliffs turning up taking goods thats for sure.

    If they dont turn up to the small claims court I suspect you wont have too much trouble with anything being in your favour.
