I can contact CPS.....I would like to contact your QC...if you can furnish details?

Could you afford the QC's charges though - which double if you don't pay up in time......:p

When bluelagoon puts his details up here then I'll seek the permission of the QC to put his up.

The 'De Brunner' case went into the fee/penalty issue in detail.

Perhaps you should read it again, assuming you even read it in the first place.

A genuine question, I don't know the answer as I haven't had the pleasure of reading a CCJ before. Are all County Court Judgment papers as grammatically flawed as this one?!

Anyone who hasn't read it yet, take a look at the link, it's actually quite shocking if this really is an example of a lawful judgment. When I revisited this thread earlier I was a bit surprised no-one had mentioned it.

There are - allegedly - so many schoolboy errors anyone would think someone had typed it out on their own pc - no, surely not?:rotfl:

I did think that too, but as I'm dyslexic I have an inherent caution of pointing out spellings and grammatical errors.

I did however notice there are more than a few mistakes :o

i dont know about the details of this whole argument per se, but i can only say that i work within a local authority and see a lot of 'transcribed' court judgements, they are quite badly done sometimes, and you do wonder that the person writing them, hasnt bothered to proof read them.

thats all i can say, i dont know if this particular one is genuine as i dont know anything about it

Thanks, I thought there may be some small errors occasionally, but in this case it's not just small proof-reading oversights. The person typing the alleged 'CCJ' in the link above hasn't even bothered to make sure some of the sentences (particularly near the end) make any sense at all.

so my question is to bluelagoon (genuine question), what about people who do park there by accident.... and just on a 'humane' (for want of a better word) level, not legally because ultimately, this is your land and you have the right to have it for whatever use you wish,, are the cars parked there at the weekend, actually affecting your business in any way??

How do you park somewhere by accident? As a driver you have a responsibility to be aware of your surroundings and what you are doing when in control of a vehicle.

In relation to how it affects our business, we operate 24*7 and it makes no difference whether it's a weekday or weekend or mid-day or mid-night - our car park is for our use and no-one elses.

I've asked this before but no-one responded.... what would you do if someone (or several people) started to use your home driveway as their own private parking space?

I almost hesitate to post here, and apologies as it is slightly off thread. I'm anxious to know how I can get a list of unincorporated companies (which I assume means sole traders and partnerships), it could save me a lot of time trying to find a particular business.

I can see both sides in this parking debate. If there are warning signs about parking somewhere and people ignore them, they face the consequences, they have after all been warned. This from someone whose only parking ticket was issued 3 minutes after the time period became enforceable. I know it is different since I was on a yellow line on a public highway, but it was my fault I was there. If I owned a piece of land that people were parking on that impeded my business, I think I would want to take steps to resolve the problem.

Hey ho, that's life I suppose. Seriously though, where to find the list of unic. companies would be a real help. Thanks in advance

There is no definitive list of sole traders or partnerships.

Actually there is no such thing as an "unincorporated company", it's a contradiction in terms.

Let's face it, there isn't a QC is there. If he or she really was advising you then you wouldn't make so many embarrasing errors in your comments.

    sarahg199,

Is there any cases on pepipoo of people being taken to Court by a PPC & both parties turning up & arguing their case robustly & the PPC case being thrown out?....by the law of averages surely there has to be one?

I couldn't agree more with this post.

I'd love to see some proof of such a case - but no one here has managed to provide anything more than their own flawed opinion.
