    no you are right and my bank said i am the first person to acknowledge that it is my fault that is not what i am disputing it is how much they charge

    I have found in this sort of circumstance that the bank (barclays and abbey in my case) have waived charges as a one-off . They have the discretion to do it and after trying the 'nice' approach I would state you are goung to go to the financial ombudsman to look into excessive charges if they don't. However this only really applies if this is an unnusual occurence for your daughter. If the account has often been overdrawn they are unlikely to be sympathetic.

    they took my daughter child tax credit money,she told them this was illegal and they paid it back.

    The Abbey keeps chargeing me interest varying from 0.1p to £1,i have not been overdrawn,it is not a bank account and i do not have a overdraft,when i contact them,they pay it back and apologise saying there is a problem with the system,it has been going on now for over a year,it costs more in phone calls than the money taken,so ultimately makes me worse off anyhow,this is with the electron account,dose anyone else have this problem.

  • can n e one help me? iv had £350 worth of charges added in th last 2weeks onto my account, but i noticed th post about that th bank cannot take your benefits, am currently on benefits as iv just had a child, is th bank right to add that many charges in 2 weeks n can i get it back??

    Basically they can't take you benefit money for overdrafts or debts, and if they have you can ask for it back !
    hi I wrote to my bank and told them this..ie they could not take my benifit to pay charges,this was after I had put in my claim for unfair chrages.I explained to them that for the past ..blah blah years we had lived on DVLA and incapacity benefit which only this year ceased when we became eligable for pension credits. Let me just say that incapacity benifit was for longer than the period I have claimed for,Lloyds TSB told me my claim was on hold untill after the court case .End of disscussion . I have told them that now and in the past I have been in severe hardship,,but Lloyds TSB do not know the meaning of this. Once this case has an ending I will be leaving TSB as they have no understanding of anything.I have since learned that DVLA is inaliable which if my understanding is correct they can not touch.If this is the case ...how do I go about getting TSB to listen???
  • Just curious to know if this law also covers EMA payments. This is a means tested payment, payed by the government to pay for further education expenses not bank charges. Any ideas?
