i no i will get called worse than muck for this but i wouldnt say this normally unless i thought you were 100% genuine in wanting to work ,

but you could claim esa for your depression you will need sick notes of your doc but you have just lost close family and time to get yourself thought that and any other matters that need sorting out its less stressful for you and atm might be better for your health, hopefully you will get work in the 12 weeks you have before a medical , even if you dont get work in that time you might be able to be supported into work group , means also your hb/ct would be sorted out then

When someone has finally managed to come off benefits, encouraging them to rush back to this trap is neither the most sensible, nor the kindest, thing to do.

the key question for consideration is not 'did she make herself voluntarily unemployed' but did she have "good cause" for leaving and IMO she can argue that she did.

The OP may have had a good cause to move from where she was living but that's not the same thing as choosing to move a distance where travelling to work isn't viable.

If she'd been moved by the council or done a council swap it might be different but the main point of renting in the private sector is that you can choose where you live and the OP has chosen, voluntarily, to move away from her work.

All true were victims of anti-social behaviour!

But the OP had none of this at their job and gave it up!

Thats the reason for the sanction and the reason they posted on the forums!

PS, since your reporting posts to abuse, did you check you could link to another site?

Tehya should stick to the topic of this thread or maybe they dont understand and have to bring other topics as examples. I agree with Vader.

I will leave this thread alone bury it, as the OP has now managed to find solutions .

    Vader:

My post was a reaction to the comment "Remember trouble dont come looking for you unless you have caused it to others..Remember that!!!" made by marydot.

Whether the OP has grounds for appeal I really don't know especially as I've never been in reciept of JSA or had to appeal.

I think it's pretty much accepted that she had to move. She moved 30 miles away for:

    1. To get away from a situation that nobody should have to contend with. The place they chose to go was also for support from family.

    2. The job she did seems to be some kind of shift work as she had to call on patients several times a day which would have meant her either staying in her old town from 7am until after 10pm every working day with no where to go in between jobs or she would have had to travel between her new house and her old town several times each way.

Her shifts seem to be the problem with keeping the job from what I can make out her working day looks something like this.

    7am - 11amm
    12 noon - ???
    2.30pm - ???
    4pm until 5.30pm
    7pm until 10pm (ish)

Maybe looking at this rota the discsion maker will see a grounds for appeal though I'm not up on the rules?

The attitude of a minority of posters is what I am surprised at, these people do not know the mental anguish their remarks could be adding too. I know others will say comments on a forum shouldn't be taken to heart but trust me some are.

Besides why can't the OP do both, appeal and look for work?
I don't think it is worth the time and anguish of gathering sufficient evidence to obtain a successful appeal when the poster already suffers from anxiety and has suffered a loss.
IMO it would be far more worthwhile spending that saved time finding a new job. More satisfying and in the long run will help her self esteem and cash flow.

    .

I get ya. I really do.

She made a decision to move and thats fine.

But she moved and _choose_ to give it up the job.

She made a personal decision about her life and she has to live with it. She can't expect to give up a job and not suffer (however short-term) because of it!

  • OP, what information did you give to Jobcentreplus when you were asked for the reasons why you left your job? If you gave all the information you have already relayed on this thread, then the Decision Maker will have already taken this into account when deciding whether to place a sanction on your claim and if so, for how long and obviously decided that you did not have good cause to leave the job so it is probably not worth appealing. However, if you did not impart all the information and have additional proof of what happened, then I would recommend that you ask for a reconsideration or appeal against the decision. The Decision Maker may still come to the same decision but there is also the chance that they may reduce/overturn the sanction if you are bringing new information to light.

I just wanted to update this and give the result. I sent off my letter and heard back that I have had the money reinstated. Not that it matters really as I now have a job! I included letters that I had sent to council members seeking help, diaries of everything going on and some other things so it did help in the end. Thanks everyone for your advice.
