Tesco misprice discussion area part 10

  • What poo.
    Goodluck with this one

I am more than willing to prove this theory by going into a store and bagging up. If the price says from £6.97 and there is no indication to say that the product you picked up is not in the £6.97 bunch then it is £6.97.

Put it this way, Tesco would, in my opinion, be rather stupid to try to fight it.

Anyway, someone feel free to post the name of a store that has no DVD or CD prices and a poster saying "from £6.97" and no other indications and I will be in there within the week with my trolly.

OK, I will try to explain. Lets say you pick up a copy of "lets tango in the bathroom" (i made that up) which is a DVD Box set which you KNOW is priced normally at £60.

You take it to the till, and it comes up £60. But wait, what did the shelf say? the shelf said it was from £6.97 and as there is no other price indication on the shelf then the price advertised IS £6.97.

Lets have a look at a bit of explaination of law provided by the goverment body "Consumer Direct"

So, just to clarify this, the only price indication you have is £6.97. However if the store corrects the mistake at the till then they have not broken the law and are NOT enforced by law to honour it.

However, if you have paid, and then complain that you have been overcharged after you have left the till, then by law they must honour the price of £6.97. As that IS the only price displayed and the pricing of something higher than £6.97 being covered by the word "FROM" is ambiguous in anyones language.

The word From only really comes into play if there is something to indicate on the shelf or product or somewhere else in the store (the till) what the correct price is.

Note that it is probably not wise in legal cases to claim you did not know the correct price when buying something if it was the only thing you bought. However it is perfectly ok to pay, go out, go back into check that you were charged the price correctly, and then complain.

Note, the above is only a theory, but I can see nothing saying that it is not correct.

I can see where you're coming from, however I think you would be blue in the face arguing over that one!

I went in a store on friday and there were no prices on the non chart games either on the case or shelf, just a "From £?.??" sign

I dont think I would have the minerals to try and challenge them on this one though.

Picked up a DS Lite today with GOTW and discount didn't come off. I had a long arguement with the manager as she said the discount didn't apply to DS Lite only DS. Eventually agreed with her that we would scan DS and GOTW and if the discount came off then I would accept that I was wrong. Took it to the till and presto no discount. Full R&R given ... but.

Went round to the next store for a Xbox 360 and GOTW and had a problem. Went through the checkout and no discount. Stood in the long queue at customer services to collect it and waited 10 mins for XBox to arrive. Once I got it pointed out I was overcharged. CS took me to the shelf and the posters had all been removed. CS took me to a member of staff who said a manager had removed the poster. Manager then appears, takes receipt from CS and says "your description has been circulated following your visit to the other storeI won't be giving you a refund and I'll be keeping your receipt". Told him he wasn't keeping any receipt and took it straight out of his hand. Asked about my £20 overcharge and he told me to leave the store!

Any advise on my next step?
  • Question for Constantine: Is it possible for a store to adjust the system for that particular store to take a discount off an item?

I think someone else has posted that it is possible for the store to change the GOTW if that helps.

No it isn't. The only way they would be able to do this is with a manual override and a normal checkout assistant would not have the authority to do so.

I never argue with anyone in a store. Did once and lost an R&R through it. Now I just explain what I am going to do next and tell them that I do not want them to get into trouble blah blah blah. To be honest it frustrates the hell out of em as you can tell they want to start an argument and raise the temperature as I am usually the one in control asking them to do thing and getting them to dissagree with store policy as I personally prefer to let people above them get angry at them. It isn't my job to tell them there job, it is my job to enforce my rights.

Imagine having your heart removed with a feather and that is what it feels like when I come into your store and do an R&R.

If I was to try to R&R a PSP today and get refused how long do you reckon it would take to sort it via head office CS?

Would it be sorted on monday?

Seen wrong signs etc in local store but cant really afford to have the money tied up in the PSP for too long.

    Just bumping the question..

Has anyone had them delt with on the same day?
