I hope to be rid of this particular cancer which permeates our society very soon, though I suspect I have a long fight ahead of me before I can once more return to my home after work without the deep unsettled feeling wondering what awaits me.

Petitioning our MP's for an early day motion is one possible way. However it is also necessary to continue to build on the mounting case law preferably for criminal acts as well as injunctions and ccjs against civil law to bring these ruthless hypocrites (criminals posing as servers of the community) to justice.
However, let's not get ahead of ourselves. There have been a good number of victories but nothing that has flowed from them, in terms of judgement, has provided the solution to the problem of the PPC business model. This carbunkle on the back of the UK populace has yet to be lanced!My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Apologies for disappearing for a while, life's trails and tribulations drew my attention elsewhere.
There have been a few developments recently.
My MSP has tirelessly pursued both the Property factor and the PPC and eventually the factor partially caved in and instructed the PPC to stop harassing me. It is my opinion that this is sufficient evidence to prove that both the PPC and the factor are liable for the harassment I endured over the last 6 months.
I'm not the only person the PPC \ factor have rubbed up the wrong way. Another person or group of people (I can't believe it was 1 person)
has/have TWICE taken down all the external PPC signage. This represents a frankly monumental effort as the PPC went way over the top when they put the 2nd set of signs up securing many with around 16 screws in addition to some form of very strong glue and others placed so high they were well out of reach (incidentally also completely useless as notices). Unfortunately they haven't or perhaps couldn't access the secure area where I park and as such signage is still displayed in this area.
I also wrote to the PPC clearly stating that I wanted them to cease conducting business on my property and failure to do so would result in a charge for their use of my land. I actually received a response to this yesterday which stated "The Deed of conditions clearly states" that in the absence of a Residents Association (which the factors promised would be convened this year but have since ignored my correspondence on the matter and have actively engaged in propaganda to discourage a Residents Association) the factor will manage the title in accordance with the detail laid out by the fue superior - a term which died with the Feudal System in Scotland in 2004 with the The Abolition of Feudal Tenure etc. (Scotland) Act 2000, and one which certainly does not figure in my Deeds (which I have in front of me). They have also said that they will fight any charges I choose to levy and that I will be liable for costs incurred - which are limited if it goes through the small claims court.
As to where I need to go from here - who knows.. They're not harassing me any more (though that threat still hangs over my friends and relatives and will affect me should I borrow a car) and I never was enthusiastic about court action but I will be pointing out their errors to them before deciding how to proceed. I will also continue to work with my MSP and write to other relevant Government departments to prompt them into action.
I don't believe that any individual or company should be allowed to profit by preying upon vulnerable people and I believe we have a right to expect that the Government(s) will take action to stop any such activity.0 -
Perhaps a letter drop to the other residents explaining the non-enforceability of the PPC's PCN's would also be a good idea.
Whilst you are at it. Invite all the residents to a meeting with regards to setting-up a residents committee with a view to then setting-up the sites own factor, thus saving said residents a big proportion of their cash in factors fees.Never Knowingly Understood.
