Thanks for the advice - it looks like this is ultimately a non-starter as I've more effective routes to consider if I am headed to court.
Unfortunately the Police still refuse to admit that there is any criminal act involved in maliciously soiling my vehicle with glue and will not get involved.
I shall continue to explore other avenues as I feel they are backing me into a position where I am being encouraged to take the law into my own hands which is totally against my principles. I may lodge a complaint against them as I do believe they have a responsibility to act and are ignoring this hoping I will give up.
Go spray glue and stick bits of paper all over the police car windscreen and then see if they think it's a criminal matter! :rotfl:0 -
I think the problem here is the police may be too hooked up on the fact the things stuck to the screen happens to be a parking charge notice, and the offender is from a private parking company. I wonder if the Police would be more inclined to act upon a report of simply someone maliciously gluing things to a car.
What I'd love to do in the OP's situation is have a big vat of ready made wall paper paste mix, some ugly !!! vinyl wall paper, and to stick it straight across the PPC's windscreen.0 -
Fair enough, but my point was that there is no trespassing laws in Scotland, which there isn't, as there is the 'Right To Roam'; so therefore you cannot have someone done for trespassing as you alluded to in your earlier post. I wasn't disputing that you can't ask someone to leave your land.
Just to clarify - and this is purely academic as I appreciate your point, but there is a Trespass law in Scotland and it is a very old one amended by right to roam etc to clarify and modernise but it still exists and can be called upon in circumstances such as that above - I have consulted a police officer on this and he has experience of this Act.

I would love to respond in kind and glue something over the PPC employee's vehicle but I need to maintain morally superior ground if I am to have a lasting and serious impact on this practice. I am already a martyr to this cause and I do not intent to let the negative experiences and stress I have suffered to date become negated by an act of reprisal. Besides - the PPC employee has decided to find new more interesting areas of my windscreen to glue things to as he/she has obviously noticed that I have been forced to coat areas of my windscreen with white spirit residue to allow me to remove the glue more easily. Personal touches such as that make me inclined to apply to the DVLA for their personal address (as I suspect they use their own vehicle, but may be wrong) and target them personally alongside the Factor and PPC with respect to legal actions etc.
I would be interested in receiving the details of a reasonably priced (I know that's relative) Solicitor/Lawyer in Scotland who can advise on how to proceed and potentially assist me in obtaining an injunction against this PPC. It's that or I will have to move into rented accommodation while I attempt to sell the flat, which doesn’t mean I will let this issue die, I don’t intend to stop lobbying against this practice and may try to claim the moving costs etc from the Factor.0 -

What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

I have a lot of time for the police and respect the tough job they do in the face of excessive paperwork, red tape and an ever increasingly disorderly society. Unfortunately, without making this political they are forced to prioritise their work and simply are not interested in following up on this sort of criminal violation though I am preparing a further letter which I shall submit by email (which I've found effective in getting a response) in the hope they will show more interest this time.
Completely agree and understand. My issue here is that it is continuted harrasement/damage and could be (possibly) nibbed in the bud with a small amount of pro-active Police time. Rather than it escalating and ending in somebody getting hurt etc.
Anyway, you really have my sympathy on this, I have a lot of respect in the way you've handled it, let's hope it's get sorted soon.0 -
Does anyone have prior experience of a Factor or Landowner receiving remuneration or other incentive for permitting a PPC to access property? I would be very interested to learn if this is common practice as I can't believe the factor would pursue this matter and try to supress opposition to the scheme as enthusiastically as they have without some financial advantage.
The factor may get a kick back for each 'penalty' received but not usually for just allowing access.
This is really what I don't understand about this, obviously the PPC is just a bunch of thugs, but the factor in this case is just plain !!!!!!. Why are they continuning with this - it just isn't in their interest when they are jointly liable.0 -

I think you are completely correct, I'm sure the Police are bored of people complaining about PPC tickets so they aren't taking it serious. This is different though, this is intimidation, harrasement with liberal sprinkling of criminal damage. The Police are foolish in ignoring something like this.0 -
Of course if the police keep ignoring the fact that criminal damage is being done to the car, you could actually complain against them, though that would be the very last resort imo, an injunction would probably be the way to do this.
