Yes, I know that but when the computer won't allow me back up because of the problem, what can you do?

thats the purpose of backing up
so that if you have a problem then you have a back up
when you send a PC off for repair for any problem, then you have to assume your data maybe formatted
  • When a computer is 5 months old you don't expect things to go wrong with it but like as I said, I was in the position of making a dvd to back up when the computer went wrong and the data on there went with it. As I replied to the other person, and as I wrote in my note I couldn't back it up as the data was on the computer and because of the problems I couldn't back it up. All I'm asking is Have They Breached My Consumer Rights. I should have been given the options before they dumped or destroyed what was legally mine without my consent. I'm just looking for a simple answer not being told what I already know about backing up.

You should contact your CC company now, and inform them that you did not make the booking and to stop the payment.

It is possible they have your cc details from your previous dealings with them, but if there really was no confirmation payment details, then this seems like an error on their system or sharp practice, a phone call to them tomorrow should sort the problem out, but as I said, call your cc company NOW!

    .
Thanks for that. Have phoned cc co and they can confirm that no request for any payment has been requested at the mo but the department which can put a stop on any request aren't open til 8am tomorrow!
I've now realised what has happened - I googled 'vacansoleil' the co we booked with before but I must have been on the iris parc website. It says 'member of vacansoleil group' and the pages were exactly the same as before when I did it. However I think vacansoleil own 2 parks which are 'iris parcs' and I've booked thru them instead of the main co! Going onto the 'vacansoleil' website I've run thru exactly the same booking pages as yesterday but it also asks me if I want to include ferry crossing etc. which is what I was waiting for on the other website not realising I was on a different site as the booking pages were identical!!!
Will have to hope they are feeling in a good mood tomorrow morning!

you have your simple answer. I dont know how to sugar coat this.
    the consumer right cover repair/replace/refund
they are going to replace it.thats it
you sent it off for repair.so if it was a hard drive problem and they replaced the hard drive.then what? you expect them to sort out data migration for you?
its you thats raising the issue if your data.
hardware and software can fail at any time.
if you were using windows 7 then it would have told you to make a back up under the issue flag.
I'll say it again. thats the whole point of backing up.
so you have your data backed up if theres a problem.
dont dismiss my advice because its not what you ant to hear.

If a problem with the hard drive was fixed in the first place I wouldn't be having this discussion, everything was fixed, all I did was explain what has happened and yes they said they will replace it. I haven't had a replacement so technically that computer is still legally mine.

I'm not dismissing your advise and I appreciate what you are saying, I was using windows 7 but to have a back up is to recover the computer incase it crashes. I again say that this computer had a more serious underlying fault hence it's gone back to be repaired. I needed to know if it was repairable and if not repairable, I should have been given an option.

All I need to know is, that while I was still the legal owner of that computer did they have the right to destroy it without my authorisation? That's all I'm asking. I'm not after sympathy. I just explained what happened that's why I put in big red letters at the bottom of my note. I would like to know what their protocol is.

Would a car manufacturer destroy a car of yours if the management system was faulty without first consulting you?

it doesn't matter what they do with computer
they have the option to repair/replace/refund
If a car manufacturer wanted to provide you with a full car to fix a fault then they could
a back up is to protect anything you want to preserve on anything happening to the PC
what would you do if a pipe burst, you had a fire, the PC was stolen etc etc
thats why you back up.to ensure you don't lose the data you want/need. the fact you didn't back up your data changes nothing about the companies requirements. Ive resisted it before but i would have thought after having HD issues you would be more likely to back up your data
  • Was wondering if anyone could help me....

Bought a dress off Republic before Christmas, wasn't suitable so returned it (recorded) to them, checked on the tracking number recently and it says unable to deliver...returning to sender-but they don't have our address and so it obviously hasn't came back to us.

I've emailed Republic and they say they can't refund for the dress because its supposedly being/been returned to us, so we'll have to contact the post office instead and try to get our money back, but surely if they didn't accept the parcel for whatever they have some element of responsibility?

If it's a shop or warehouse or whatever they should be accepting returns constantly? So would it not be their fault? :s

    Any help would be appreciated!

    okay.first
why didnt you put a return address?
sounds like theres an issue with he address TBH.was it sent to a PO box?
you need ot contact RM customer service and inform them. if it has no return address then it will go to the Belfast office
It might be its simply been mis scanned

Didn't think I'd need to tbh :/. It was returned to a PO box in the Republic bag with the invoice inside..basically how they tell you to do it, if they looked inside my address would be i there but doubt they would.

Ok will give that a try, thank you! :)
  • Custardy, I agree with what you say, they either repair, refund or replace, where is it in there that they say they can destroy.

As I've explained that computer is still legally mine. I'm in no receipt of a repair, a refund or replacement. Nearly 3 weeks have passed and still nothing. I take into account the holidays seeing I was promised by them that I would have had it before Christmas.

Please read where I wrote, I couldn't back up my data as the computer prevented me from doing so. I think thats where you fail to understand. It was beyond backing up.

And to say I should have backed up my system which I have over the past 10 years backed up my data on a third party system and which I was using at the time of the computer failing.
