Taking this further forward; I've taken a call from the Ministry of Justice who regulate these companies this morningThey don't seem to have many complaints about this company?
we need a more people to contact the MOJ to get something done about the fact they've text/called out of the blue.
I've logged a complaint upon the breach of the data protection act with them, they will need more complaints to actually do something about them. so guys and gals, this isn't "the bandwagon", companies like these have no right to use someone's personal data in this manner without the persons consent.
This must be looked at for what it is, the use of personal information without YOUR permission. what's going to be next? the data goes missing and we all find ourselves dealing with the worst thing ever: identity theft???
Contact the commission, their contact info is below; quoting the company reference number: CRM21359. The MOJ people working there are decent enough, they call you back if you can't get through initially and are willing to listen. Give them the telephone numbers that have been used to contact you (07564683545 / 01617131883) and you've found out the company is called "Bankfair limited" they will do the rest.

'They don't seem to have 'MANY' complaints about this company.' Meaning the HAVE received some complaints, surely that is enough to set their wheels in motion and act? Perhaps I expect too much from a regulatory body?
I posted off my complaint to both the MoJ & the ICO last week so it's too soon to expect a reply but I will post here as soon as it arrives.
I hope more people put pen to paper to stop these morons....

I received a letter from the MoJ in response to my complaint about this company for sending unsolicited promotional texts. It was a standard letter but it stated that upon the information provided action would be taken against the company. I queried the 'action' to be or could be taken and this was the response:
The Unit must take any action in respect of breaches of conditions of authorisations in line with the enforcement policy of the Unit.
Potential enforcement action that may taken includes, but is not exhaustive, informal and formal advice and warnings, written undertakings, suspension of authorisation and ultimately cancellation of authorisation. Although they seem to be able to withdraw the companies license, the tone of the explanation provided tells me that it would be more than likely some 'informal' advice. AKA a smack on the wrists and told not to be a naughty boy again. In the same vain as the ICO and Phone Pay Plus.
At least our complaint is on record should they happen to start up again.

I got a telephone call from the MOJ, they didn't seem very interested that these companies are using personal information without consent of the person they are contacting, using the excuse that everyone has put their personal information on the Internet at some point. :mad: From experience working in the civil service it will be a slap on the wrist or the finger waved at them saying "don't do that again!"
The fact that the Data Protection Act has been torn up with the sale of personal data just doesn't seem to register with the MOJ at all. :eek:
Quite frankly the the 'J' for Justice should be changed to Jerks or Jokers.0 -
I've had exactly the same text today from a different no: 07756239924 so they have started again. I seem to get these unsolicited debt texts every few months - I'll get lots over a period of a week and then nothing for a couple of months. I did text STOP to one number but have just deleted all others. I am also registered with the tps and I'm always careful not to give my mobile no out so I'm thinking it could be through my phone co?0

Same text received, so sent the following email:Hi
Today I've received the following unsolicited text message to my personal mobile phone;
"Wipe off your debts!:Begin your application and start wiping off debt with a New Government Settlement Order from April, reply YES to find out more otherwise no"
It originated from 07756239924 which when traced relate to the following company:

County: Cheshire

I have NEVER given my number out for marketing purposes (same mobile number for 5 years) so I am fully aware of what they can and can not do.
I ask that you take immediate action as I am seeing a lot of other people complaining that they too have received these unsolicited texts over the past 48 hours.

I received the same text from +44756239941 on 18-10-10.
This really irritates me. I have already received a text from another number and complained to the Claims Regulation email address who still haven't replied.:huh: Don't know what I'm doing, but doing it anyway... :huh:0 -
I've just received this text from 07756249311.
So they certainly are still being sent out, I'm going to raise a complaint with the ICO, I don't particularly care which company sent it, but IF Bankfair are genuine (I notice they have posted without permission from MSE) then perhaps they would pass on the details of the mysterious SMS company.
Incidentally, James from Bankfair claims they do not and have never sent out unsolicited SMS. Then in the next sentence says they employed a marketing company to do this 6 months ago!0 -
