    Between no and 4 months depending on what bit of evidence you read.

    The video may have Carmen saiying she paid £6k upfront

    Suzy has apparently said she was staying on friends sofa and floors for a couple of months because Carmen wouldn't get out and that she returned from Spain as no rent was paid for a couple of months.

    It's all a bit of a pigs ear isn't it?!
    Surprised that it still isn't known if the tenant actually owed any money.

    Not to mention that the tenant was supposed to leave in April, despite having an extension contract granted in May... :p

    Course, if she paid £6k (or I understand 6 months) up front there are those who assert (it is a point not always agreed on..) that the "period" of the tenancy is thus 6-months rather than the more usual month & any notice periods thus revolve about that 6-month cycle... Oooohhhh so that means Suzy Butler, IMHO a criminal (criminal eviction) - but she is considered otherwise by others & may be as pure as the driven snow - should have given the Tenant between 6 & 12 months notice BEFORE being able to start the court case..

    Ah, shame...

    Section - 5 Security of tenure

    (1) An assured tenancy cannot be brought to an end by the landlord except by obtaining an order of the court in accordance with the following provisions of this Chapter or Chapter II below or, in the case of a fixed term tenancy which contains power for the landlord to determine the tenancy in certain circumstances, by the exercise of that power and, accordingly, the service by the landlord of a notice to quit shall be of no effect in relation to a periodic assured tenancy.

    (2) If an assured tenancy which is a fixed term tenancy comes to an end otherwise than by virtue of—

    (a) an order of the court, or

    (b) a surrender or other action on the part of the tenant,

    then, subject to section 7 and Chapter II below, the tenant shall be entitled to remain in possession of the dwelling-house let under that tenancy and, subject to subsection (4) below, his right to possession shall depend upon a periodic tenancy arising by virtue of this section.

    (3) The periodic tenancy referred to in subsection (2) above is one—

    (a) taking effect in possession immediately on the coming to an end of the fixed term tenancy;

    (b) deemed to have been granted by the person who was the landlord under the fixed term tenancy immediately before it came to an end to the person who was then the tenant under that tenancy;

    (c) under which the premises which are let are the same dwelling-house as was let under the fixed term tenancy;

    (d) under which the periods of the tenancy are the same as those for which rent was last payable under the fixed term tenancy; ................

    The facebook page is not managed by myself alone, but by a group of like minded, tax paying, hard working individuals who are all shocked by the lack of protection and fairness a private home owner faces when renting their primary home. All we want to do is raise awarenss of the issues, help others not experience the trauma I went through and help create a fairer system whereby tenants and landlords rights are equal.

    It is not logical or fair to have your primary home taken over by somebody who refuses to pay the rent, for whatever reasons. Surely, if you take on a house signing a contract to pay £1,200 a month for a place, it is your responsability to ensure you can afford this and not live beyond your means, gamble your money away and then simply refuse to do the "right" thing, which is to move out and find a way to pay back the money owed?

    At present the system is open to abuse and simply doesn't make sense. Why is is right for somebody to live for free in somebody elses home, break the agreed contract terms and conditions and be able to stay there, while the other person pays for them to do so? I run a childrens charity and earn just £14,000 a year. I needed to rent my home out for a while so i could save money and afford to keep my home on. What Ms Nobre did was selfish and morally wrong. I do not have much money and this is not a business, but a private let to help me create a better life for my son. I am open to discussion but people have created a battle zone and have become abusive, threatening and are ignoring the facts. I am not a rich landlady. I earn less than those on benefits!

    Many people are suffering under the current law, and all we want to do is encourage a change whereby the period of time between a tenant stopping to pay the rent and an eviction order is gained, is shortened. As had the media not supported me, I would still be homeless and would have been over £10,000 out of pocket by the time I eventually got this to court.

    2 months in arears is fair, but the process after that needs to be shortened. That's all we;re trying to. I have worked very hard, as a single parent, to raise my son, provide a home and life for him and this woman and the law have disrupted and upset my life hugely. It is morally wrong. Believe me, I have thought about it from all sides and simply want landlords letting primary homes to have more protection. The law needs balancing out again so that both sides are heard and treated fairly.
