I have read their returns policy, but - and it is easy to be wise after the event - why didn't you check before you ordered? Three are not the only network that tries this ludicrous exception on (phone must be unused and no sim card inserted!)
A warning to all MSE members - read the t&c before ordering. May not be helpful to OP and let's hope the regulators cease this loophole, but may help others.0 -
I agree, you can't break the contract because you have used the SIM and started the service.
Have you tried the SIM in another phone, the IPhone 4 as pointed out has known manufacturing issues and gets poor signal reception.
You should be able to return the phone for an alternative, but the contract should still stand.
But many of the above users are right. If you do not read the terms and conditions that you have agreed to, do not be surprised if you end up hitting a brick wall because you didn't realise you shouldn't have done something.
The issue with signal i will agree does mean you need to use their service in order to check it, which is why its recommend to get a PAYG SIM first to check out the service or ask people living in your area.
Its an up hill battle, and as has been said if you want to challenge it then take them to court and let a judge decide. Put forward that you are not getting the service you paid for and three will turn up and state you are receiving service however the level of service varies and is out of their control (They can only control radio frequencies to a certain point), you would loose.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

I can't understand the defensive stance towards three. I'm not denying the t&c's say What they do (which is crazy and I can't see how it would ever stand up in court, I say again, how can you judge a service without using the service).
The fact is I'm getting such slow 3G speeds in my home town and in the surrounding villages that I cannot use the phone for the use it was purchased for. It's attack the innocent week on mse forums obviously!0 -

Therein lies part of the problem. People aren't defending Three, they are criticising you for a) not reading before opening and b) trying to get out of the contract because of a). That does not mean people are defending Three. Robt are you visually impaired? I've read the t&c's and that's not being debated. I was merely asking for advice, but you clearly have none. Other people were replying with advice, but not you. If you read my posts I'm not debating a lack of signal, but a completely, impossibly slow 3G performance. The postcode checker as I said shows good indoor/outdoor but what's the point in getting a good signal, at less than poor speed. You are not being at all helpfull mate, so I'd love it if you would just leave it there, I check back for useful advice and get your replies instead.0

It can be said the same for home broadband with the speeds etc, dependant on network. Im on 3 and sometimes I cant get my 3 etc depends on the building as others have said. They will just blame your house.0

I absolutely see what you're saying, but when their coverage says your signal is strong, and your iPhone says 4 of 5 bars strength, but you only manage upto 60k downloads, it's unusable0
