Thanks for that. A positive step. But the logistical problem still exists. Lots of phones and no one to sort things out.
Can you suggest to Dennis that, since he can contact them and MSE members can't, he asks them to put a notice on their web site indicating what they intend to do about all the phones they have and how they plan to settle with sellers?
That would ease a lot of minds, I am sure.0 -

Add me to the list too. Sent my W995 to them and they confirmed that they would issue £35 on the 15th July however due to a busy time it may take longer than the 10 working days. Grrrrrrrrr I am so angry at the thought of being conned. It may only be £35 but that's a lot for me just now. I can only pray that they resolve this and issue payments or give us our handsets back.0

i have also sent a w995 on 13th july and was promised £75 as like brnad new so i pray also that we can at least get our phones back. At least the imei numbers will match to the relivate owners if some one can sort them all out0 -

It would have been nice to have a statement from rusell as a courtesy to his customers not just a message to say they have ceased trading how rude and ignorant even if he had no control over the situation we all deserve and explaination dont we:t:t0 -

No worries I just want to get my phone back or the cash i was promised for it!! I sold mine to pay towards my daughters b'day present so am really gutted cos she'll be the one missing out now!!0 -
I've just spoken to Dennis from the storage facilites Earth Mobile used, they have not gone bust apparently they have just ceased trading as they could see the company going downhill. Apparently they have left the offices with all phones still inside, so there is hope yet!!! Windsor Self Storage are currently waiting for instructions from EarthMobile on where to forward all mail etc
Surely if they havent gone bust we can all get our phones back???:T
The good news is that they have made the decision to dissolve the company for whatever reason , maybe a fallout or death or change of tack etc. If the company is solvent they will just pay all the outstanding debts and notify all the relavant authorities.
So if this happens and the companies final accounts drawn and you don't get paid you can sue the directors
However they may have come to the decision to cease trading because they consider themselves insolvent or close to it, which I have to say is more often the case.
The problems are that the company is a LTD one and has to be liquidated
If this is now a voluntary liquidation it means they will appoint their own liquidator's and costs taken out of the company assets.
The only good point I've ever come across regarding a VL is that they have to do it 100% by the book.
The slightest error in the liquidation such as paying creditors in the wrong pecking order etc. would mean the outstanding debts would become the director's responsability and you could make claims against them
My own opinion is that if we know that they are still receiving mail and it is going to be passed on you should stake your claim in writing by recorded post asap so that your claim is there early doors
If and when a liquidator is appointed they will have to notify you and recognise you as a creditor and you can bring it their attention once more.
Can I just also make a point here too ....This thread will show up on most search engines first page and as sure as eggs are eggs those connected with Earth M:eek:obile will be reading itIt's not just about the money0 -
Legal ownership of the mobile stays with you until the agreed payment is sent and cleared in FULL, demand return of your mobile via its imei number - it is NOT a asset of the companies until payment, its your asset !!If I helped or saved you money - Thank me
