    Im absolutely amazed when reading the T&Cs for this so called professional band. They state they must be supplied with a hot meal for each band member, they will not accept buffet food or 15.00 per head will be charged.
    Also if they cannot break down their equipment at a certain time they will charge hundreds extra.
    I was in professional bands/acts for many years (about 12) and making do with a stale ginsters pasty from the service station was all part of the evening. As regards to getting your equipment down and getting home, every night was different and it was all part of the gigging business I'm afraid.
    We worked everything from weddings, nightclubs to large marquee venues for military occasions.

    The band we had at our wedding had exactly the same terms so I suspect they are standard.

    In all fairness to the band, they do state that the terms are designed to stop people taking the mickey and that the terms are negotiable prior to booking.

    I have to agree with Equaliser that it is not really fair to abuse the SEO to discredit a company based on one customers situation. By all means the OP may post reviews wherever they see fit.

    The point of this board is to give consumer rights to individuals. It is not the purpose to be judge, jury and executioner to companies that you have had no prior involvement with. To start a vendetta against this company would be nothing more than ignorance which i was quite shocked to see from regular posters on this board.

    Isn't that exactly what the band are doing, taking the mickey!

    It certainly seems from this situation that they are using unreasonable, heavy handed, scaremongering tactics. They certainly don't seem to have used their negotiating skills!

    I'm sorry but I really think in this situation they are being wholly unreasonable. Have they even offered a gesture of goodwill, such as they will accept 10% of the fee seeing as the cancellation is so far from the performance date? Probably not.

    All they have done is send a standard request for payment and then sent a LBA. People are often directed by this board to send LBA's to companies when they have these problems. It is not being abusive, but is how court proceedings work.

    Don't get me wrong, if they were to start small claims action i don't think they would win, but if they want to try, that is their right.

    P.S. Within contracts negotiations would normally be concluded prior to the contract being formed, not once a cancellation has been requested.

    No, i think it may be foolish as a judge would say that not enough time was given to resolve the matter, but not heavy handed or scare mongering.

    I pointed out in my last post that negotiations would take place prior to a booking being put forward.

    I certainly don't think that the OP is in the wrong at all and i think that for a contract to be formed some sort of consideration would have needed to be made, therefore i feel that they would fail in court action.

    I do think that it is wrong for people who have no prior knowledge of who this band are, to start a petty vendetta against them regarding a matter that does not regard them. This is a forum to come to for advice, not to start a vigilante.

    Completely agree. Ultimately if the terms and conditions are not enforceable, a Court will determine that.

    Actually just looked at their website. They actually seem very good.

    Totally wrong in my view to try and destroy a bunch of musicians business because they may or may not be heavy handed about trying to enforce their T's and C's.

    OP, you should have legal cover on your household Insurance/Bank Account/Car Insurance. Are you in a Trade Union? You'll get free legal help if so. Check for any of these and they should help you out.

    I'd be going to court on a matter of principle. Especially seeing as the final hearing will be at a place of your choice (Please live as far south or north as possible!!) and they would have to pay at least £130 to get you into court in the first place.

    They would have to tell the judge that they are suing you because they want you to pay full price for a booking that was never confirmed with payment and have no cancellation notice.... er, go on then. tell them you'll see them in the court of your choice in about 3 months time. I am sure you do not need the stress but it'll be a nice little tale to tell your kids one day.
