Without Prejudice
NOTIFICATION OF COURT ACTION TO XXX
We have not received payment of your cancellation fee which was due on 10/8/2010.
As previously explained, if payment has not been received by 10:00 am on 11/8/2010 a County Court summons will be issued in your name as the original booking was made in your name.
Once the summons has been issued you will be notified by the court and given an opportunity to pay the claim or defend yourself in court. In the event that you lose the case you will be charged additional legal costs, court fees and interest.
When you made this booking you entered into a legally binding contract with us and agreed to our Terms, Conditions and Cancellation policy. I regret that we are not in a position to waive the cancellation fee and will not hesitate to take legal action if this matter is not resolved immediately.
Please note that no further notification will be sent before a court summons is issued. Failure to respond to this email could result in substantial additional costs or a judgment being entered against you in court.
OP, did they write "without prejudice"? If so i find this highly amusing as it basically means they dont want their own LBA to be used as evidence in court...........so how they would prove they sent you one (which is imperitive in small claims cases - to show you have tried to resolve the issue outside of court and that court is a last resort) is beyond me. I dont think they've used it appropriately either, see below:- Only use 'without prejudice' if there is an existing dispute underway.
- Use 'without prejudice' only if you're making a genuine attempt to settle the dispute.
- Don't make assertions, and expect them to be protected by the 'without prejudice' rule.
EDIT: just to add as a side note. If you are indeed communicating with them, do not admit to owing them anything or even having a confirmed booking. See a solicitor then respond to them.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

I'm ready and waiting, and no longer scared by the bullying tactics. It's an utter shame that people have and will continue to be bullied in these circumstances.
I know this is what is wrong about all this in that many people become very scared and intimidated when these companies start using legal talk and threats of court action and many people will panic and pay up out of fear.
Just because a company writes Terms and conditions doesn't mean they are legally binding because quite often they are unfair.
If it states in a businesses T&C's that if you breach this contract you must buy the owner of the company a new car, would you do it. No.
T&C's are open to scrutiny and anyone should question them before they cough up any money to these unscrupulous companies.0 -

So Hula Groove are threatening to sue you because you wanted to cancel after 3 days of booking, but not confirming. I looked for Hula Groove Review or Hula Band Review. Maybe it's hulagroove band, not the Hula Groove Band, and the website? www.hulagroove.co.uk it says they are a party band, is this correct? I thought they were a soul band and not a party band. Or maybe they are both.

If you notice HULA GROOVE REVIEW only give one day to pay so thats not exactly giving anyone a chance to sort a problem out.
They also managed to be psychic. Or perhaps its a different date in the dreamland they apparently live in.
