Grrrr! why do some ebay sellers lie in descriptions!

Hi all, am so disappointed. I bought what was claimed to be a New without Tags Buzz lightyear costume for my son, described as bought as an xmas present and never worn. also described as aged 4 - 6 years.
It has arrived today and I opened the packet and the smell of washing powder or soap hit me immediately. I unpacked it and there is a one and a half inch square stain on the very front of the costume! Also the costume label reads the size as 5 - 8 years which is going to be far too big for my son!
I have just emailed the seller stating all this and advising I would like to return the item for a full refund.
But I am so angry, my son has been waiting on this costume for a party and although he is only 3 yrs old, he is going to be so upset.
Grrrr! why do people have to lie! :mad:
So my question is - how long do I have to wait before opening an SNAD dispute via paypal? Thanks very much

It's going to cost you £20, but to save disappointment get him one from the disney store. If it's so bad, open a SNAD now.0

i don't think you "have" to wait at all. so its up to you how long you think is reasonable to wait for a seller response. i'd maybe give 24-48 hours but thats just me.0

thank you, am just really annoyed that people think it is acceptable to behave like this and more so as my little boy is going to be upset.
Thank you for the tip about Tesco, I will go and have a look later on and see if they have any.
and failing that, will be off to the Disney Store.

Thank you, the seller has just responded claiming that the costume must have been damaged in the post and that she has witnesses when it was packed to confirm that there was no stain. and that she will not accept liability for items damaged in the post.
That was enough for me, I replied telling her that the item was clearly not damaged in the post as there is no damage to the packaging which I have kept. In fact I will be returning it in her original packaging which was a padded envelope. I also advised her that in view of her response, I would now be opening a dispute through paypal - she said that the size error is a genuine mistake, which it could be which is fine, but she still has to take responsibility for selling something as new when it was not and the wrong size also.
I think I will have a battle on my hands here so am taking it to paypal right now lol!BSC #215/No.1 Jan 09 Club0 -
Take photos before sending of the damage (stain) Open up a dispute send the item back via tracked mail
Sellers cant refuse returns

ok, dispute is opened, should I just escalate immediately to a claim or give her time to do the right thing and refund? sorry for all the questions...

I would wait and see if see refunds only for a few days if she has no intention of refunding then escalate it
