I have just emailed Mobilise informing them of the Exeter case and asking for their comments. Going on past experience they won't reply to me. Have they got something to hide?What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Yes but they were only crippled with pain, unable to walk, needed urgent prescription painkillers, were unable to defend due to total incapacitation.
Their answer may be something like!
However they failed to display a blue badge so we agree with UKCPS. Even allowing for this persons proven disability we find UKCPS acted correctly! We are however working with UKCPS to have a better understanding of their practices!0 -

IMHO my first thought is that this motorist can consider counter-suing the retailer/service provider for effectively not making a disabled space 'available' to him if he fitted the DDA definition of disabled at the time. Making a space available but then taking him to Court for a ridiculous penalty is certainly not treating him equally with other motorists and he has the law on his side.
The compensation would be a lot more than £150. There is a case from the past on CAG where the poster did just that and the Supermarket settled out of Court for a few grand IIRC. And that was only because their disabled bays were full - this case is surely worse, to make a disabled provision available and then not cancel a 'charge' when the person alerts them to their genuine need. Never mind the Blue Badge signs, the Equality Act (previously DDA) takes precedence surely.
Please check it out Alexis - this could be worth a counter-claim. The retailer and/or their agent the PPC should have cancelled the 'charge' as soon as they were made aware of the disability. Look at the wording of the Equality Act re 'making reasonable adjustments'.
A counter-claim like this is needed to stick it to Haswell and send a strong and very expensive message to the hand that feeds him (retailer/landowner).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There is one consolation County Court judgments are not binding as a precedent, so basically this Haswell character won by default, and any written submission was insufficient to win the argument. Had the defendant been well enough to attend the result may well have been different/

It just shows what a sick individual that Haswell is doesn't it? He travels about 700 hundred mile just to take on someone who is that ill they can't defend themselve's. He then goes onto a website to gloat about it. He must be so proud, What a man, what a hero for the PPC brigade.
I notice they have changed the postcode for their Huddersfield address to the main sorting office in town. Well, their office is in Standard House Half Moon Street Huddersfield in the centre of town.
I'm in town tomorrow so i will go and look and confirm, they do like to hide behind PO boxes don't they?0 -

Now he has stuck his head above the parapert he will be anxious to conceal his address as some character, a ppc hating version of Captain Gatso might put a wheel clamp through the office window.
The office when known should be picketed by disabled drivers, wheelchair users, and mobility scooter riders could 'escort' him to his car. He would probably call the police to disperse the dangerous individuals who were excercising their right to lawful peaceful protest.0 -
I hope the disabled driver appeals or sues the landowner for breach of the DDA.0
