Faulty D500 - Seller lied about condition

  • Its odd, tomorrow was the last day she had to respond to a claim, and when I check the status today, she has responded and Paypal is showing status as this:

    "The seller is in the process of faxing us confirmation that they already processed a refund for this transaction. If the seller does not respond by the deadline, the claim will be decided in your favour. The seller's deadline for responding to this claim is 1 Oct. 2006. No further action is required of you at this time."

    I haven't received a refund of any sort from her for this item, what trick is she trying to pull here? Is there some sort of loophole that I don't know about?

    For one thing, I know for fact that she is delaying everything by responding to Paypal at the last minute.

    If its going to take long, I am just going to flog it back on Ebay, although I will be losing a few pounds for no good reason.


    Since it's such a lousy phone judging by what you say............I trust you'll advertise it as such...i.e. not working, badly dented and scratched..etc???

  • What about contacting your credit card company and getting them to instigate a chargeback in this situation?
    Although the OP may have not used a CC in this case.
    In general can you chargeback through your CC company for items not as described or is it only for non receipt?

    And on the same note does anyone now anything about Paypals own Credit Card wondering if you can do unlimted chrgebacks and wether or not they still get shirty when you do a chargeback using their own card?
  • I did look into going thru the CC company, but then I realised that I couldn't coz I stupidly paid through my paypal balance which was +ve at that time. So depending on paypal to clear the claim and refund the money really.

    A long shot, but you could look at recently ended or listed phones of the same model, and do a google images search. If the phone doesn't look like the one in the picture, then it might be that (s)he took the picture from elsewhere...

    If you can show this then it will make the seller look like the inherently dishonest one...

    So you can contact them yourself. And if you find out that the seller isnt the person with the account, then I guess they could get in trouble for that also

    Also.. they are insisting on payment by cash. The following link says that this is against ebay rules..

    Well, apparently, paypal gave me my money back coz she didn't respond to the claim. However, i get this message from her today, any idea on what I should do?

    "right first of all. you have two choices 1, give me the money back right into paypal. 2, send the phone back in the exact condition it was in. i have enough proof that i sent the phone and if my paypal doesnt get the money back in it. i will take this matter to court. i have informed paypal of this request seeing as they are so thick to see you have wrote you recieved the phone. you know what your taking the p--- because i sold you the phone as faulty, so what it aint my fault you cant fix it. the thing about the scratches and snaps was complete bull and you know it? i have complete proof about this so if you dont send the money back. or the phone which you have probably sold. i will take the matter in to my own hands."

    Won the claim fair and square, so now she's threatening with court action.

    First, paypal must have asked her to prove that it was the phone she sent, and then she pretended to have refunded my payment. She failed to send in any proof of refund, so Paypal credited my account. I am just wondering, if she had the proof all along, how come she didn't send it in to Paypal?

    Now that she has lost the claim, she's threatening me with court action. Obviously, I could send the phone back as I still have it, but my thinking is when she gets it, she will obviously start up a row again saying that this isn't her phone. Not quite sure what to do now, replies would be most appreciated!

    dont worry about it

    really, just forget about it all!, ignore emails, etc and walk away.

    obviously as u had a refund, u should return the phone, if u want to escalate things, refuse to unless they pay return shipping!
    money saving my @rse.
    I've spent 10x as much as I would if I had never discovered this website :-)
