Faulty D500 - Seller lied about condition

Have reported her to Ebay for false contact information though, but that isn't exactly going to achieve anything.0

With Ebay? They say if you paid through paypal, then you have to go through paypal for that process. Will try to do it now, but am not sure if it will let me. Just tried, it won't let me open one until the 16th but if paypal rules in her favour, there's not much Ebay can do, can they?bleugh wrote:file an item not as described0 -
The onus is on her to prove it is or isn't her phone. If she hasn't taken photos or serial numbers then that's her look out.
I photograph and UV mark certain things that I send out, particularly for this reason.
PayPal can still find in your favour. Hold in there. And be as sensible and factual as possible. For the other person (PayPal rep) reading the dispute they're going to take more notice of the realistic person than the one flapping their arms about.
Also... if the phone is damaged not in the manner she sent it in, then it was damaged by the postal service. AGAIN, her problem.
What is Mr. Fonz?0 -
Her response is the one I would expect. I still believe that paypal could go either way, a faulty phone is a faulty phone and it is rare for a buyer to win a paypal chargeback because a faulty item had a different fault on arrival.
I would still caution thinking before leaving negative feedback, if she retaliates with a neg she will render your account almost useless, especially if you plan trying to sell in the future.

Yes, she will most definately retaliate considering how she has responded.
However, I do think feedback is what it is meant for and if nothing else, I will be leaving a big negative. In the least, it will dent her 100% positive. Ebay is nothing without feedback, if she had had -ve feedback, I would have exercised more caution in buying from her.
And in my case and hers, it will get eroded as we buy/sell. As per the selling, if there was anything else I had to sell it would be the furniture in my house when I did move back home.

Fair enough, I agree that feedback should be left when feedback is due. Your feedback though, for whatever reason, is below that level at which many people would buy from, another neg will make your account almost impossible to use as a seller. You would probably need several hundred purchases to regain a percentage that makes it easy to sell in future.
It isn't fair, but sometimes you do need to see who is affected most by an action. We often talk on this forum about how negs might not make a difference if they say 'the right thing' so if your seller leaves a clever negative along the lines of buyer negged me as he expected working phone..and people see the auction for the few few months as being a faulty phone it could cause doubts and reflect badly on you. Sorry, I don't think I am explaining this properly..but hopefully you see what I mean

Yes, I can see your point of view now.
And on the other hand, people don't bother seeing whether you sold or you bought. So any buyers from me think it was me selling the phone and thereafter caused hassles.
What a sad fact, can't get my money back, and can't leave negative feedback. More of like, let it go coz you can't do nought about it.
No wonder people have two or more accounts on ebay.0 -
How long does paypal take to sort out claims?
If its going to take long, I am just going to flog it back on Ebay, although I will be losing a few pounds for no good reason.0 -

I think Paypal gives the seller 10 days to respond. Your seller has already responded, so shouldn't take too long.In a rut? Can't get out? Don't know why?
It's time to make that change.
