Faulty D500 - Seller lied about condition

I bought a faulty D500 on ebay like 7 days ago, and the phone arrived today. Thought it would be the common flex problem, which is easily fixable.

Unfortunately, it was not what I was expecting. The seller clearly mentioned that there was only a screen problem, and is working perfectly. When i got it today, however, it had only been posted yesterday, doesn't start up, it has previously been opened up, flex cable has been removed, and flex holder has been damaged.

On top of that, the phone cover has a long vertical crack.

What do you do with such people who keep on lying on ebay?

She knew about all this, but didn't list any of this on the auction. And I am quite sure she intentionally did this.

Have filed a paypal dispute, but she isn't responding. What do you do with such cheats, moreover someone one with 90+ feedback. If people with such good feedback start lying, then how do you continue using ebay?! :mad:

    I think the first thing you should do is leave negative feedback. The seller is still on 100%.

    I don't think you are likely to win a paypal chargeback. On any auction where item is listed as faulty paypal assume that is what it is..regardless of what else is said, so a claim that item is faulty will fail.

    You could of course leave negative feedback but as your own rating is already quite low it will definitely affect you more than it will affect your seller.

    Did you contact the seller before you filed the chargeback?

    If they dont respond to the Paypal claim I think they will award in your favour anyway....hope they dont provide a response!

    Dont ever leave a neg before exhausting all routes...you will loose your final bargaining chip! You have 90 days to neg so no rush
  • The last e-mail I received from the seller was on the 8th when she mentioned that she had lost internet access, and would post the phone out on the 8th by special delivery btw.

    I filed a "Not received" dispute yesterday, and when the phone arrived today, I put more info on the paypal dispute about how the item was not as described. Talked to a paypal rep, and they advised putting a note on the account mentioning the item had been received but was not as described.

    But evidently, she lied, posted the phone out yesterday which I feel is because of the paypal "Not received" dispute I filed yesterday again.

    Tried contacting her via e-mail, but she doesn't respond. Tried calling her with the contact info Ebay provided, phone line is invalid.

    No I didn't contact the seller before i filed the chargeback, because I have sent her several e-mails between the 8th and yesterday asking her for the tracking number of the parcel, but no replies to that either obviously because she hadn't posted it out yet.

    It isn't a chargeback as yet, jus a simple dispute and I haven't escalated it to a claim.

    I could leave her with negative feedback, but maybe I should wait until she responds? Is there any way I can get my money back?

    D500s are known to have a common flex problem which sometimes leads to white screens, funny screens, upside down screens, and sometimes sounds, but no displays. This is because of the constant tension put on the flex cable as a result of opening and closing the phone.

    In such a case, all you need to do is replace the flex which costs like 3 pounds on ebay, and isn't difficult at all.

    But with this phone, the flex holder is broken, so I can't replace the flex as it won't hold firm.

    Report her to ebay for invalid contact information. They'll most likely suspend her. I don't know whether you'll then win your PayPal dispute by default but may be worth a shot.

    I agree misdescribed and invalid contact info. One thing I did pick up on though:

    Yesterday being the 12th September. You won the auction on the 6th September. I think you were a little hasty in filing that. 6 Days isnt a long timeframe. People cant get to the post office that quickly and she didnt offer rapid shipping.
    Maybe filing the claim has upset her enough for her to ignore you? Just a thought. Doesnt excuse the rest though.

    The item was special delivery, and I did receive an e-mail from her on the 08/09 telling me that she had posted the phone out. So the phone should have been with me on the 09/09. And the package indicates that the phone was posted out yesterday, so why lie?

    And I have a feeling she didn't actually post the phone out until she received the e-mail from Paypal telling her that the buyer had filed a "Not Received" dispute which was yesterday.
