You can wok and claim DLA at the same time.

Can you provide a link on this? I always understood that the employment status of the claimant was irrelevant to the legitimacy of the claim - it's not an out of work benefit like ESA.

Yes Jowo you are correct - you can have a full time job and still get DLA - it is not a means tested benefit. have a look on the direct.gov website it explains further about DLA.

Employment status is irrelevant to DLA. However, you couldn't claim DLA on the basis that you can't prepare a meal for one and work as a chef.

What I can say is that on current rates and if he is receiving the Higher Rate of both elements, the payment would be £121.25 per week - £525.42 per month.

Hi, I receive the Higher rate of both elements and I don't receive £525.42 per month, and no one claims for care allowance.

I know people on DLA are allowed to work which is a good thing, but I don't know what employment you could do if you receive the HRC to be honest. I certainly couldn't go out to work as I am almost completely housebound. The only thing I could possibly do would be some computer work AT HOME and only a few hours a week.

I don't know how the decision makers make their decision within the care criteria of DLA.

I certainly don't understand how Abcynthia's sister in law's boyfriend would be awarded HRC given the way he is able to live his life - being in his employment, going out drinking, DJ in spare time etc.
  • no one will now be "gauranteed"dla past 2013 as this is when the new govt are bringing in medicals for all existing claimants

Excuse me for being stupid but how do you work as a chef when you can't cook a meal for one? Did I misunderstand?

Do you mean those who say they have depression but don't?

So why can't you get DLA? I thought you would get it if you can't cook properly.
